  7. V6Pony, It is common for the VA to use NPs and PAs for all C & P exams except mental health and hearing loss. My C & P exams for Cancer and peripheral neuropathy were performed by an NP. I felt like an oncologist should have performed my Cancer exam and a Neurologist should have performed my exam for peripheral neuropathy. It is not fair to veterans to have VA C & P exams conducted by incompetent examiners. As a result, VA rating officials often deny legitimate claims resulting in long and unnecessary appeals for many disabled veterans. In my opinion, veterans dramatically improve their chances of winning their claims if they have a thorough IME by a doctor who specializes in the diagnosis and treatment of the condition being claimed and by providing the VA with an IMO from the specialist supporting the veteran's claim. The IMO should follow the format shown on the Hadit website and be supported by reasonable medical rationale. Also, submit the IMO along with the evidence being submitted with the original claim.   8. Some great comments above. My mother and wife have both had Champva for years. Now they both have Champva and Medicare (part A and part B). Basically, they have 100% coverage. I wish veterans were offered Champva. Like Broncovet, my wife and I have had coverage by several insurance companies during our lifetime, Without exception, Champva is the best insurance out there. One thing not mentioned above is Champva's "Meds by Mail" program where Champva members without other prescription coverage can get free prescriptions by mail with no copays. GP
  9. Buck, It does vary by State. Also, a few states give exemptions to vets rated at less than 100%. Take care. GP
  10. nsmiley77, Any award rating at 50% or above places the veteran in priority group one in the VA healthcare system. Since you are now in priority group one, you no longer have any copays for VA appointments or VA prescriptions. You can receive VA healthcare free of charge for any medical condition (service connected and non service connected). You can also receive retroactive reimbursement of all VA copays you have made back to the effective date of your award raising your rating to 50% or higher. You can request the reimbursements through the business office of your local VAMC. Take care. GP
  11. WOLF14, I took a copy of my VA award letter and my AB8 (Benefits Summary Letter) to my county tax office, completed a form changing my tax exemption status to "100% P & T disabled veteran." Once I die, my widow will be able to continue the exemption and receive the same property break for as long as she lives. GP
  12. sevensees, Tell your father not to take original records. He should take copies of all relevant medical records and offer them to the examiner. He should definitely take copies of the two letters from his psych doctor. The examiner may or may not take them. I have always had good experiences with the examiners taking my records and actually using content from the records in their C & P exam reports. Your father should not rely on the RO sending his records to the examiner. Personally I think the examiners, who are often NPs & PAs, are more likely to offer an opinion supporting your father's claims when they review medical reports from his doctors, especially specialists, and the reports support his claims. In the case of a claim for a mental health claim, the C & P examiner will be a mental health specialist and hopefully will agree with your father's psych doctor if the two letters are supported by reasonable medical rationale in his medical records.     Champva

    NeedHelp91, Do not wait to start the Champva application process. It is great insurance coverage. It is simple to update when you lose your employer sponsored insurance. My wife just updated her's this week when she called Champva and advised them she no longer had BCBS insurance as of July 1, 2015. You can call Champva at 1-800-733-8387 anytime to notify Champva of changes regarding your other health insurance. It is a fairly simple process. You can also complete and submit VA form 10-7959c to Champva to notify them of changes in your other health insurance coverage. A side note: If Champva will be your only insurance providing prescription coverage, you will become eligible for Champva's "Meds by Mail" program. Since my wife dropped her BCBS insurance, she has Medicare (part A & part B) and Champva. Her medicare coverage does not provide prescription coverage so she is eligible for Champva's "Meds by Mail" program as of the date she dropped her BCBS coverage. The "Meds by Mail" program provides prescriptions free of charge delivered by mail to your home. No copays and the prescriptions can be refilled every 90 days. Good luck and take care of yourself. GP
  15. Go to benefits.va.gov and type in "Title 38 U.S.C. 1151 claims." This will give you the info on what is required for 1151 claim and how to apply. As Lotzaspotz indicated, if you have discernible damage caused by the actions of the examiner, you will need to get a paper trail established before you file. I would not do anything until you have an exam by an orthopedic specialist. GP

  17. Jusus, Please listen to the advice given above by Lotzaspotz above regarding 1151 claim. Since a C & P exam is a VA sponsored exam, I would think 1151 would apply if your current condition is aggravated or you suffer a new injury as a result of the C & P examiner's negligent actions during your exam. JMO GP

  23. Calgon, Good advice provided by Buck. I think you will need much more for your OSA claim to be successful. Even if he did provide an opinion, it would have to be supported by reasonable medicale rationale. Just curious, was this one of those C & P exams where the doctor conducted the exam by telephone? In my opinion, absent evidence in your SMRs supporting your OSA claim, you would need a strong IME and IMO from an ENT specialist who specializes in sleep disorders in order to have a chance of winning your OSA claim.
