I just got a decision in the mail about rhinitis.  I have service connection but only to the effective date of the law change.  I filled for Gulf war conditions in 2013-2014.  Denied and appealed all the way to the BVA and no dice. Until now but with a crap effective date.   I feel this is win but I can't say that I am overjoyed.  Denied higher ratings for Hypothyroid and GERD, service connection of sinusitis under same regulations and denied the higher ratings on law changes in 2017.  But approved for Rhinitis with an effective date of August 5, 2021.  Geesh why do I have a feeling this is going to be the norm whenever the laws change in the Veterans favor, effective dates go out the window it seems.   Im getting tired but Permanent and Total is just barely over the horizon and seems attainable

      It's an easy first move for them.  Most Veterans will take it and leave, i.e., not fight for more.  And they know that.

      I had a HLR about six months ago.  From the records review, it looks like a copy and paste of the first denial, but during my interview for the HLR, I did mention the new law and presumptives, and whether any of that would apply.  It's been crickets for that last six months, so maybe they are trying to apply that to my claim.  And, it they do I will probably get the new date to.  LOL...

  2. have had community care for a while now.. just diagnosed with basal Cell Cancer. Tricare is a PIA, when it comes to getting the ok for appoinments.. the worst bean counters.... I had no clue until I used them.. oh well.. at least I can see docotro, someof the time,, they are stil behind of some of my issues... stil ldidn't cat scan my pancreatic and liver disease for 2 years.. were suppose to at least one per year.... as usual sick laying around the house... cya laterz...

      I hear ya. 

      Tricare says they can't tell us where my wife can go for care until we sign up (she's 30 year Multiple Sclerosis) and she currently uses about $150,000.00 of healthcare a year.  So, we will keep our private Medicare advantage plan.  Can't take the chance.

  3. Well, Social Security shot me down, again. I guess I'm not disabled enough. 😠😠😠 100% totally and permanently disabled per the VA.

      Sorry, the answer may not be what you want to hear, but it is a good answer.  The last date insured is a hard and fast rule with SSDI.  I have not read of anyone overcoming that.

      My wife was shot down twice too.  SSDI is very different than VA comp.

      Now, you can appeal again and get a court date with a judge a year or two out.  That's what we did.

      Then I found ALLSUP on the internet.  I gave them a call and they are not lawyers, but paralegals that do SSDI for a living.  They get 20% of back pay.

      They had the ability to short circuit the system and meet with the judges staff and my wife got SSDI about 4 months after the call, a year and a couple months ahead of seeing the judge.  

      Judges, lawyers and paralegals make deals you or me can not.  We got the disability check right away, but no healthcare for 24 months, which didn't matter because I had healthcare through work.  But the SSDI check sure helped out.

      Her back pay was $6600.00 and they took something like $1800.00 for their work.  Easy peasy.

      One warning, they have a 98% percent success rate.  You will find out with the call whether they will take you or not right off.  If they do, you will win.  If they don't, then you probably don't have a case. 

      The phone call is free.

  6. I don't know why I've been scared to click the decide your claim button I'm just tired of waiting I have submitted all my information.

      If this is just a normal claim and you have all your information in, then I don't think it matters.  I have used it in the past and it didn't change anything for me.  If you hit the button and then something pops up on there end, it just goes back to being a normal claim.
