  1. Does not affect CRDP for Medically retired vets but does give full retirement to unemployables and CRSC for medically retired military.
  2. I think that I'd answer again because not sure what the last post says. There is no offset when you combine SSDI to VA compensation.
  3. I don't think it would do any good to get a lawyer to apply for SSDI as they almost always will not take your case until your turned down. I take that you don't have an active application since you didn't mention any reconsideration requests. You should be able to apply yourself and get as much info together as possible to turn into the SSA folks. Steve
  4. I just found this document from the House Armed Services Committe. Also, note the title of the address as this might be the final document? It really isn't surprising (except for the folks that say that everyone is denied the first time) because almost 60% are actually approved the first time around and 6 months is the average for first timers. You will get the statements it took 3 years but these aren't initial decisions but appeals. Steve

  8. I have to agree that there is always a chance of losing IU when you open the door for a reevaluation. You are now IU P&T which gives the same pay/benefits as 100% schedular P&T (except if your military retired and even this is being worked on). Steve

  10. No, the pay chart has just been changed today to the the correct amount $2669 for veteran with spouse. Yesterday it showed $2772! Steve
  11. Did anyone notice that they made a mistake on 100% member with spouse; they show 2772 which is the same as member with spouse and child. I believe the new pay should be about $2660 or so. I would expect VA to correct this error soon. Steve
  12. I would say that a Request for Reconsideration (remember that nowhere in the reconsideration are you to say that you disagree with the decision) would be much faster. I used the reconsideration at the local level because I had new evidence. I received a decision in about 4 months. Steve

  17. I'm sorry but your the first person that I've ever heard that took 2 1/2 years on an initial decision. An initial decision usually takes between 3-6 months and then if your disapproved and ask for reconsideration this is where the long wait usually happens.
  18. Just because items are listed in your medical files doesn't mean they are service connected. Need to be service connected to get the rating. Steve

  20. Whether or not the VA folks admit it or not; it really is a "battle" to get our earned benefits. Congratulations on your increase and now it's time to get back into the trenches! Steve
  21. Concurrent Receipt is for 20% or more for CRSC and 50% or more for CRDP. Note: You can be rated at 60% for single disability and qualify for IU. Steve
  22. IU stands for Individual Unemployability which equals to 100% rating even though your total rating could be 60-90%. According to VA you normally need at least a 60% rating on one disability or 70% overall rating with multible ratings with one being at least 40% in order to be considered for IU. Steve
  23. You can be P&T 100% schedular or IU. When you are Permanent and Total (P&T) there are no exams scheduled and you are entitled to educational benefits. If your award letter doesn't mention a future exam, says your permanent and total or your entitled to Chapter 35 Education Benefits then your Permanent and Total. Steve
  24. Congratulation on your award. Did the award letter you received say when your next eval will be? If not, I think you will receive another letter with more particulars. I strongly recommend you request a copy of your SSDI files and make a copy and give provide a copy to VA for further evidence on your IU. The files will list your primary and secondary reasons for approval of SSDI. Steve
