HELLO, CARLIE AND ALL THE WONDERFUL VETS OUT THERE, As far as the reason for denial of my claim for RAYNAUD'S PHENOMENON I had a bad C&P examiner, There were no test done, the va examiner just looked at my records ask me a few questions, And did not put what I said on paper during the exam, Some of the questions that was ask were. Are there effects of the problem on the following daily activities? NO (i said yes) Is exercise or exertion precluded by the condiction? NO, (I said yes) ECT ECT ECT BS. ALSO the examiner stated, IN MY OPINION IS THAT IT IS NOT SECONDARY TO HIS DLE. RAYNAUD'S PHENOMENON MAY BE ASSOCIATED WITH LUPUS BUT IS NOT CAUSED BY IT. MY NEW EVEIDENCE OF SUPPORT, Will be what I pull off the internate, Like the va training letters, and the research done by National Heart Lung and Blood Institute, ECT ECT ECT. (THANKS FOR THE HELP EVERONE). ALSO a copy of a letter that my VA doctor gave me in support of my claim, That states Discord Lupus is but one category of skin lessions that can occur in patient with lupus. There is some overlap. Patients with Discord lupus have a predominance of symptoms that do not involve internal organs. Discord Lupus can be a slowly progressive diease with joint sysptoms such as pain, stiffness and swelling. Raynaud's phenomenon is also in patients with lupus. IT IS AS LIKELY AS NOT THAT RAYNAULD'S PHENOMENON AND HIS JOINT PAIN TENDERNESS ECT ECT ECT ARE DUE TO HIS SERVICE CONNECTED CONDICTION OF DISCORD LUPUS. HIS DISABILITY SCORES OF 1.0/10-3.67/10 ARE RELATED TO HIS ARTHRITIS. (THE SCORES I DONT NO WHAT THEY MEAN). TITLE (MD MS RHEUMATOLOGY SECTION). I submited this to my VA rep today, He said that a reconsideration will be the next move and also we will watch for the NOD date, He also stated that the doctor did a DAMM GOOD JOB. ( I HOPE THAT THIS NIGHTMARE WILL SOON BE OVER). PS I HOPE THIS HELPS SOME OTHER VETERAN.

HELLO, Again I just don't beleive what my VA REP tells me, I called and told him that I had new evidence in support of the claim concerning the DENIAL for RAYNAUD'S DISEASE, I told him I will wait until my other claims were finished, He said NO bring the evidence in right away and he would fill the reconsideration or NOD. Now if I am correct this will hold up my other claims, I took his advice before hesitantly, He said that my claims would not be held up on other issues, We filed the claim, And sure enough my claims were held up. Don't get me wrong I think there are some good VA REPS out there, But when I got the first rejection for the claim for RAYNAUD'S DISEASE being secondary to DLE, I told one other VA REP that the decision was wrong and he replied , YOU CAN'T fight the doctor (C&P examiner). Even though he was a trainee its no excuse for a !!!!!!!! statment like that. I do have another VA rep but I am also leery of him also. WHAT THE ?
  9. HELLO, BERTA, Thanks for the imformation. The only link that I have for Raynaud's to be secondary is that I have DICORD LUPUS ERYTHEMATOSUS. I had this disease since 1976 whitch was misdiagnosed by the VA DOCTORS when I was in the service, they thought I had psorasis, I did not find out what I had until 1986, the damage was done by then, I did not file until 2002 for benifits from the VA because of my lack knowledge. I will file for a reconsideration on this claim denial when I get the decisions on a few other claims that is already in the system since May of 2010, One of the claims is for a reconsideration for MDD that I put In at the end of August 2010, It has been in the system for six months and counting, The original denied claim for RAYNAUD'S PHENOMENON was August 17, 2010 I guess I have to watch the time frame for sure when I file for a reconsideration on this RAYNAUD'S claim. AGAIN THANKS FOR THE INFO.
  10. HELLO, I just talked to my VA Rheumatologist doctor about my problem with my C&P exam doctor stating that RAYNOLDS DISEASE was'nt secondary to DISCORD LUPUS. THE C&P doctor stated that RAYNOUDS PHENOMENON may be associated with LUPUS but not caused by it. So the VA denied my claim, Stating what the C&P examiner wrote, That the diagnosed Raynauds Phenomenon is not secondary to service connected DISCORD LUPUS ERYTHEMATOSUS. The examiner stated that the two conditions may be associated, but Raynaulds is not casused by LUPUS. Therefore, service connection for this condition cannot be granted on a direct, secondary, or presumtive basis, and sevice connection is DENIED. My VA Rheumatologist doctor said she would write a later in support of my claim disagreeing with my C&P examiner statment. I hope this and the VA training letters will be enough for filling a NOD. I will wait until my other claims are finished before filling a NOD OR RECONSIDERATION.

DONT worry about hijacking my thread, because you are right, I was thinking the same thing as you were, As for every RO the processing of claims is differant and the rating system is also, Thats just the way it is for now, I can only imagine the pain and suffering also confussion that alot of our VETERAINS have to go through that is much more disabled than me, also I do feel for the raters because they are thrown under the bus, It has to be a nightmare at times. (I think someone left the barn door open during a thunder storm).

  13. HELLO, VELDRINA I will try to explian my IU claim again. I filed for an increase rating for DLE SEPTEMBER 2009 I was rated at 30 %, The VRO granted my request, and raised my percentage from 30 % to 60 % in (AUGUST) 2010 of last year, I was also granted a 30% rating for MDD IN (SEPTEMBER) 2010 of last year therefore making me 70 %, The MDD claim was filed in DECEMBER of 2009. The VRO stated on the AUGUST 2010 award decision letter that they would incease my rating for DLE and they also DEFERRED a rating for IU. I guess it was automaticaly DEFERRED because of the 60% total rating. All the nesscesary forms for IU was filed out and sent back to the VRO at the end of september of 2010, So my question is, If IU is granted what would be the IU compensation start date? (SEPTEMBER OF 2009 DLE claim filed date). ( OR WHEN I FILED OUT AND SENT BACK ALL THE NECESARY FORMS AND PAPER WORK FOR IU IN SEPTEMBER OF 2010). THANK YOU FOR YOUR TIME
