I filed a claim in october of 2018 for ptsd and TDIU, long story short I tried to do everything myself and didn't have the proper diagnosis so I was service connected for anxiety based on having a medical marijuana card diagnosis for anxiety but the rating was 30% and I much worse off then that. So I obtained a referral from the va to a fancy psychiatrist from the university of north florida's behavior health department and was diagnosed with ptsd, bi polar 1 and panic disorder. I used this new medical evidence as my supplemental claim evidence and filed it April 16, 2019 after receiving my letter March 20, 2019. My claim is now at Pending Decision Approval with an estimated completion date of july 2, 2019 which is super fast from all I have read. My question is, Am I going to be awarded tdiu with the evidence I submitted if they adjust me up to 70% which I think it will . Or if they award 70% for ptsd on this new supplemental claim will i have to re-apply for tdiu again? Or would that all be considered in the final review of the entire claim? A little history this has been an issue since 2001 and a hell of a ride, so I assume since 5 years will put me at 21 years it then will be a protected status. My original claim (15 years later) was 50%. I went for an increase about 10 months after.I went for an increase for my PTSD as things were progressively going downhill. It looked as I may have been granted 100%, though they came back with a 70% with no routine future exams stipulation. It was explained by my VA contact that this means I will receive this raiting until my death as long as I do not go back to try for any increase or attempt to as that could put me back in the line for a future exam. Has anyone heard of such a thing or the VA doing that with other claims? I would think the best bet is to let sleeping dogs lie, and never ask for an increase or at least wait until the 20 year mark has passed in the event the disability continued to worsen.Thoughts?
Sucessful Claim! -Timeline- June 2011 - 6th VA claim filed October 2011 - 1st Gathering of dust phase on Ebenefits, no other info available online November 2011 - 2nd Finished submitting all evidence, called Peggy to verify that no more evidence was needed at this time. 15th VA reports that my medical records can not be located and my claim proceeds using alternate evidence I had previously submitted February 2013 (yes, no updates for quite a while) - 2nd First and only C&P Exam (30 minute exam, I felt as though I was treated fairly by the examiner, he was brief but thorough) 22nd Ebenefits jumps to Pending decision approval 25th Ebenefits jumps to complete, decision letter sent 26th The link to download VA letters on ebenefits shows AB8 with monthly award ($2816) and benefit explorer shows 70% rating when refreshed. Today Brown packet arrives in the mail with full explanation on decision (70% TDIU), I call Peggy to find out that the Retroactive Back Pay ($42,500) was sent to wrong account number! Peggy changes my direct deposit info to the correct account number and assures me that in about 14 days the back pay check will be deposited into my checking account and that the VA computer system shows my first compensation payment will hit my checking account in 2 days time. That's my story. I've been reading these forums for a very long time and I decided that I owe each and every one of you a hug and a thank you for all the great information I've come across. You all have helped keep me sane during this complicated process. I don't know what else to write at the moment but I'll keep you informed of any changes and I'll answer any questions if you guys and gals have 'em. Thank you all and good luck in your battles. I check ebbenies today and my AB8 showed me rated at 70%, but it also show the pay rate as single. I also check the benefits explorer and it showed 70% on both and P&T. I currently still have a dependency claim thats open but pending decision approval. The thing I was wondering is what to do next? I have been getting the VA pension since 2011 which would mean I am P&T so shouldn't I be rated at 100% and P&T and not 70%? I don't have SSI or SSDI. It's been a long battle with the VA. I don't know what was rated what yet. I will keep you guys updated.
