PTSD (Personal Trauma) Claim changed to GAD

I put in a claim twice for PTSD Personal Trauma and both times they changed it to GAD increase. So my C&P exams are schedule for GAD increase and not PTSD. I just had an exam today and the examiner stated it was for GAD and not PTSD which I was so confused. I called the VA and told them, I was scheduled for something I did not put a claim in for. Now they are researching as to why it was changed. Has this happened to anyone else? I was diagnosed with PTSD by my Therapist/Phychiatrist for over a few years now and I am having such a difficult time with compensation. Any suggestions on what to do next? -
At a current rating of 70% for Unspecified Anxiety disorder with MDD, is it possible to get a increase without a C&P exam? The IMO rationale & DBQ were added as evidence. I have been getting Mental health treatment at the VA since my last award also.

Sleep Apnea diagnosis

I am secondary serviced connected 70% percent for MDD and Anxiety (Tinnitus can't sleep). I was recently diagnosed with OSA sleep apnea by a VA doctor (sleep monitor test) and my question is, if I were in the future to file for an increase for my MDD and Anxiety, could the VA reduce or terminate my compensation because of the Sleep Apnea diagnosis (OSA)?- 7 replies

A Gulf War veteran friend showed me this decision he just received: "1. Service connection for the purpose of establishing eligibility to treatment for generalized anxiety disorder, panic disorder and adjustment disorder with depressed mood is established." "2. The previous denial of service connection for post-traumatic stress disorder is confirmed and continued." "6. The previous denial of service connection for major depressive disorder is confirmed and continued." "9. The previous denial of service connection for anxiety disorder is confirmed and continued." We determined that the following conditions were not related to your military service so service connection remains denied Post-traumatic Stress Disorder Anxiety Disorder Major depressive disorder *Reasons For the Decision ( #1): A determination of service connection under 38 U.S.C.1 702 is for the purpose of providing eligibility for hospital and medical treatment for veterans of World War II, Korean Conflict, or Vietnam era; or for Gulf War veterans who develop an active psychosis or any active mental illness during or within two years from the date of separation from such service or within two years of the end of the war period, which ever is earlier. The veteran was discharged on May XX. 201l . A psychosis/mental illness was first diagnosed on June XX, 2012. Entitlement to treatment is established because a psychosis/mental illness was diagnosed within the required period of time. ----------------------------------------------------------------------------------------------------------------------------------------------------- It appears then that service connection for treatment for generalized anxiety disorder, panic disorder and adjustment disorder with depressed mood was OK'd, but, apparently denied for compensation purposes. Not even a 0% rating. Anyone ever heard of such a thing? Seems like a contradiction as 38 USC 1702 provides for a presumption of the mental illness disability being incurred from military service. The mental illness disability must therefore be service connected. No C&P exam(s) whatsoever were provided to this veteran. A claim for PTSD was denied even though his VA mental health doctor diagnosed it and provided a nexus letter which was mentioned in the decision but apparently not considered. -Any help appreciated

Hello all, This is my first post in the forum. I got out the service in 2006. I put in the anxiety claims in 2012; first the claim was denied and I appealed finally got 50%. After 50%, I disagreed so I appealed again for anxiety disorder in the past 2 years after VA granted with 50% in 2012. After 2 years waiting, I finally got the Cp exam a month ago for the appeal in 2012 . In 2014, I put in an claim for Iu and I know my criteria does not fit for Iu (50%); but Vocational rehab at VA stated the I'm currently not stable for school that why I put in the IU claim. I only have one job lasted for 6 months since 2006. I have a couple questions regarding the two claim indicated above. I went to the QTC exam last month, the Doctor agreed that my disability should be at 70% and she specifically told me to put in the IU claim after the increase. But I did put it in already so should this be a problem. Once again, the doctor told me straight up to file for IU. 1. My question is if I'm going to get 70% then retro should be back since day one when the 50% was granted? 2. If IU claim is approved then when is the pay started, 2012 or 2014? 3. Ebenefit for Appeal claim in the past 2 years show no status or changing at all ; but last week it showed that "Statement of the case" sent, is that closed? 4. Ebenefit for IU claim show last week the status was changing back and forth between "preparation for notification" and now back to "pending decision approval" why is this happening? 5. I've called VA in the couple times last week, reps always tell me different answers. First is my appeal is done, and my Iu is pending, but now they said that both cases are done SOC sent the same time. Why the answer different? 6. If the cases done then why the generator is still showing the same status even though the SOC sent last week? 7. If my IU is denied, should I put in and appeal or reconsideration? Should I go back to the QTC doctor and ask for a statement to support the IU if it deny. Thank you in advance for all the help.
