  1. hello. Nubie here but I have a desperate question to ask. Is this directive still in effect (see the link)? I have a VSO that I believe is not going by the rules. Case in point...Chapter 115 during the covid-19 pandemic, state that no veteran need NOT to do.... certain things. I would like to have an answer to this before I bring this up to my VSO Monday. I'm assuming this is still in effect...yes? No? If no, where's a link that says it's no longer in effect? Thanks in advance! Broken soldier/ Pacmanx1 I haven't received my decision letter yet, but my cousin notified that you can go the letter generator page on benefits and bring up the commissary page and it will state if you're P&T. He was correct, it states that my disability is permanent and no future exams are required. Will the decision letter state all of your entitlements as far as the VA is concerned? I'll also see what the state of Ga. offers.

  4. Hello, I am currently rated at 70% for PTSD and have a gambling addiction due to my anxiety and depression and gambling numbs my emotions but is having a heavy toll on my family and life. I have blocked myself at casinos but online casinos are very easy to access I want to stop gambling and wanted to see if the VA offers this type of support? Also, does the VA give ratings on gambling addiction? I really want to stop but am so depressed. Any advice would be greatly appreciated.

  6. I applied for this years clothing allowance and have not got a denial letter from the VA and have not received the allowance. Does anyone know if the allowance has been paid out yet?
  7. I submitted my claim 9/24, I had the C&P exams on 11/6, and I am still waiting. I talked to my VSO today and she said I was "Awaiting adjudication" and that it could be several more months and I may need more exams. I know the VA is a long process, but it has been 10 months already and I am not sure what "awaiting adjudication" means. The VSO seemed a little annoyed, I call about 1 time a month, it just is frustrating. I don't know why a claim should take 10 months, I know I have read about appeals taking years so I shouldn't complain. I just feel that 10 months is an unreasonable amount of time to be "months away"

  10. Hi, Berta (everyone), I am curious if there’s any instructions on how to go about: DIC is granted & accrued / death pension benefits are denied. My VA rep (Colorado VA office), recently explained to me that my mom was awarded DIC benefits ( I filed on her behalf ), effective the day of his death (my dad died Dec.30, 2017) of... 1-Pneumonia 2-COPD 3-CAD but, we (she) was denied accrued because the Army / VA did not owe him any money, since he never filed for benefits while alive. While that part is true, he never filed because he was told he did not have agent orange, he was told he “wasn’t in the right theater”, course that “theater” explanation is false. Vietnam establishes theater now, period. My dad was on ground (in air) for a year. Further my dad’s records I received from archives (medals included) do not have a lot of information in them. I have a hard time understanding what they do say. My dad was 191st Military Intellegence, not sure if that is why I have trouble making sense of the records they gave me or if that has anything to do with why I had such a trouble free approval on DIC portion of our claim (approved first time & expedited approval within 3 months)..to which we are grateful. However, I have an original document from 1989 that reads, “ In regards to YOU’RE request to be tested for agent orange...Donald L. Welch...” (my dad)..you’re appointment is scheduled for ...1989 at ... etc. then written in red pen on the top of the document is written “6-8 weeks”. I prusume his “testing” (set for an entire day 8am-6pm) did not inform my dad he had exposure, because he then would have filed! Yet, clearly he did (death certificate reads CAD) & DIC awarded for presumptive CAD! Throughout his lengthy medical history of: Arteries blocked (multiple), Surgical stents, cardiac-arrest, COPD, bronchitis-chronic, lung problems, etc. He believed he did not qualify for benefits. Months before his death he went to VA medical at his brothers insistence & on the way home from getting RX (for the first time ever from the VA) he told his brother he was told he wasn’t in the “theater” for agent orange benefits. By the time he got his first RX delivered through the mail...he was dead....of CAD. How do I prove establish that he would have filed for benefits (as far back as 1989, document attached), if they had not told him he didn’t qualify & wasn’t exposed? How do I get addditional records when he was military intelligence? I can’t even find out what battles, his medal citations are even from. I also know his helicopter crashed while he was in Vietnam and his back had either whipping marks or shrapnel scarred all over it...I want to know why. No records if him being a POW. Can anyone link me in the right direction? I’ll have to figure out how to attach documents to post- will follow through.

I have watched for years now our 100% PT Service Connected Disabled Veterans, who served our Country, served her proudly and through no fault of their own, were injured, honorably discharged and unfortunately unable to have the opportunity to committ to a 20 year career and now being passed over and denied again and again, the benefit to be eligible for the DoD's Space A Travel Program while other non uniformed service personnel whom never served, get added into the Eligibility Categories as if they were the cat's meow! It's time to RIGHT THIS WRONG! It's time to stand up and be heard, listened too and taken seriously! Let's get the word out there! Let's get it out there Loud & Proud and hopefully see a change this time! :) I have started a Petition to send to President Obama and to Congress about finally following through and amending the DoD 4515.13-R Regulation to include a "Category 7 entitling 100% PT SC Diabled Veterans" for the Space A Travel Program. I am hoping the way I have written the petition and the way I wish for them to amend the eligibility categories that it will pass without concerns and/or complaints from the nay sayers, the Joint Chiefs, DoD, The Secretary of Defense, the military uniform service members, DoD employees, 20 year retirees and/or any other eligible personnel. The Petition is asking to add an additional Priority Category 7, which will be the Category that includes our 100% PT SC DAV, hence placing them at the bottom of the Priority list for any available passenger seating that may be open. I am hoping this will make everyone happy. The DAV will finally be eligible and have the opportunity to benefit from the Space A Travel Program without any other eligible uniform category member to give up their priority listing.   12. I am the sole caretaker for my spouse which makes it extremely difficult to leave and go to a VA facility to file my claim. When I registered for Ebenefits it says I have to have a Premium Account but I cannot just leave for the in person verification. It is imperative that I get benefits because of recent health status and also the full time care my wife will need if/when I need a treatment plan. Can somebody direct me on how to get VA Form 21-526 filled out and also to obtain my C File? I have a portion of my medical record frm my time in service in the Army from 1972-1976. Any help or guidance is greatly appreciated, I live in a fairly remote area without a local VSO or Rep. Regards

  14. I'm not sure I'm in the right place but I'm looking for all the help I can. My husband, after 9 years, has decided he needs more help than he's getting. I'm proud of him for making this decision. My questions are, what are good military only ptsd programs? He will be inpatient or do a retreat and doesn't want to leave our home state of NC. I've googled and can't find anything good. Also, does his benefit pay get reduced? He is 100% p&t for tbi/ptsd. Last question is since I'm his caregiver and he will be going away for a month or so, will my caregiver pay be reduced or d/c until he is back? I greatly appreciate all the help!
  15. I am rated 100% for PTSD will going to groups cause me to lose my rating? I was hospitalized and they encouraged me to go to groups. They encouraged me to go to a rec therapy group and my psychiatrist over the phone encouraged me to attend a nightmare group. This is hard for me to do but seems like a step worth taking. My concern is they will take away my benefits the instant I attend a group. Is it true that you lose your benefits for attending a group?

  17. Are VA Vocational Rehabilitation counselors granted access to a veterans medical records or compensation and pension exam information? I went to a VA Vocational Rehabilitation Counselor in order to apply for Voc Rehab benefits. Would like to further my education. My Vocational Rehab Counselor and her supervisor stated that education is not feasible for me based on things that were listed in my C&P exam and by my civilian psychologist 2 years ago. (I have Major Depression & PTSD due to MST.) I honestly feel that my Vocational Rehab Counselor and her boss invaded my privacy. They are not health care professionals. I am in a much better place than I was two years ago. Are they allowed to view my medical records or C&P exam without my permission?
  18. I am currently employed as a federal law enforcement officer, retiring in a couple of months. When you reach age 57 you are mandated by law to retire. With the SC conditions (I'm 70%), I have, I will not be able to acquire employment in the exact discipline I'm in. I currently earn six figures but upon retirement but my pension will be $50K . I have a BS in Voc. Educ, and I would like to work as a school counselor or teach. I am new to this process, so can anyone share what's the best way to approach in terms of seeking approval with Voc Rehab & Employment so I can get a Master's Degree? Do I even have a chance of getting approved? I have at least 10 years of "Work Energy" left.
  19. I read that if you are have one spouse and one child you get a certain amount of VA disability compensation (perhaps $256). I currently have 60% disability rating. If and when I get divorced will my VA disability compensation be reduced? ...and if yes, by how much? If I then should remarry will it then increase again by the same amount? Also, do the children have to live with me in order to claim them? ...or is paying child support sufficient. Thank you in advance. update - I am already receiving a monthly VA disability compensation. My question is: will I receive the same amount of disability once and if I should remarry in the future? ... and will I still be able to claim my kids although they don't live with me the majority of the time, and pay child support? Hello, I recently checked on ebenefits under Benefits and check the SMC box and I was wondering if anyone can tell me what this means: SMC(S-1) Entitled to special monthly compensation under 38 U.S.C. 1114, subsection (s) and 38 CFR 3.350(i) on account of medical conditions rated 100 percent and additional service-connected disabilities of limitation of medical conditions independently ratable at 60 percent or more from 05/26/2015 to 10/01/2015. Rating Date : 11/09/2016 (Medical conditions is what i put to conceal them). Does this mean it is still active since the rating date is 11/09/2016. I am still waiting for the official paperwork even tho they closed the case on 11/17/2016(still haven't received any paperwork).
  21. Hello again Vets. So today I was sifting through E-Benefits, and entered the 'Payment History' section. I looked through all the Post 9/11 Payments and MGI Active Duty payments and seen all the times I've gotten my GI Bill check. Then I click on the 'Returned Payments' portion and.... WTF? There are 6 separate entries under the tab. All between the years of 2008-2009, totalling about $7,500 - is this money that was sent to me and I can reclaim? I tried to chat but being here in California it was too late, so I took down the 1-800 number. Anybody have insight on this?
  22. I am in the NWQ and have been since June 13 2016. My claim just got pushed back to April 4, 2017 as a completion date and it could be longer. How is it possible that the in NWQ is going to benefit any veteran or even the VA? I have documented proof of the illnesses I have now that began in Vietnam but the Raters that view them cannot see what's in plain sight, or they are just continuing the tradition of ignoring the facts, in order to deny or at least delay benefits. I don't have the luxury of waiting years for the VA to correct this situation and it is a clear and unmistakable error going back to 1971. There is so many things wrong with the system that it cannot be fixed and it will screw around till way after I am dead before it ever gets any repairs. Half of the employees should be fired and the other half trained because they do not know what they are doing. I don't think they understand what evidence is, or how hiding and destroying it affects the veteran and his dependents. Many do not know what any medical terms mean at all and cannot relate them to the veterans disabilities. How could my claim get pushed back an additional seven months when it's been sitting there for two years or more already and is cut and dry. The VA completely screwed up in 1983 ( A clear and unmistakable error) and so did the Army in 1971 ( another clear in unmistakable error when I should have been discharged medically), and they don't want to admit it. They would rather I die than to admit a mistake and properly compensate me. The VA was wrong, and they know it, but the upper level management lie to its employees to take some of the guilt away because they get paid well enough to let veterans die without it bothering them. It's easy to mark claims incomplete and put them in a bin to sit for years and years while we veterans die waiting. I saw where two of my claims were marked incomplete but the bedrooms employee I'm working with says they are not incomplete but I expect they will never be viewed in my lifetime. I have never seen so many dishonest actions in my life from one organization, And it's the people at the top that are ruining the system not the average employee. The upper level administrators lie to it's subordinates without telling them the truth about where those claims go, or how long of a wait, or why they wait without being resolved. They are doing the governments dirty work and don't even know they are letting people die, or be denied the benefits they are fully entitled to. How long do we sit in this fony NWQ? There probably isn't a time limit or a death limit as to how many will die before it's fixed, is there? Isn't the in NWQ supposed to speed the process up? It is a total failure or is purposely designed to kill more veterans. It's not a mistake that we sit there for years on end but is a design to allow the veterans to die. 300,000 veterans died and no one even noticed. That's how good the VA is at hiding and covering up our deaths and destruction. Is there not anyone that can force the truth out of the VA's management? No one is accountable for anything, And 12 veterans day discover the truth.
  23. I'm pretty sure there is information regarding my question somewhere but I'm still little confused on what is the difference between TDIU and P&T? I thought when you are granted TDIU you are automatically 100% and your kids and spouse are subject to chapter 35 benefits? and P&T just means it's permanent?
  24. To be short and sweet i found out I am facing an MEB today. i am wondering what i might expect for benefits and how they work. Some ppl say you cant take va compensations if you get 30% MEB or more. others say i will have to pay back my separation pay if i take it ($90,000 maybe). and i really dont know how to judge what money i will make outside the Army. i have bad feet, ankles, knees, hip, back, left shoulder, ptsd, anger issues, migraines, sleep apnea, restles leg sleep disorder, depression. if all of these are 10-20% 140-280 % what do i do?
