I am 100% P&T and I applied for and was granted Helpless Child for my stepson before his 18th birthday with little or no problems from the VA. He is now over 18 and eligible for Social Security benefits, but we are having issues with the SSA and the VA. Social Security is docking my son's SSI payments and counting the helpless child payment as income for him because I am getting the helpless child payment on my VA disability. After lots of calls and back and forth, we have finally got SSA to say that we need a letter from the VA showing the break out of the payments and that the payments from the VA is only for me. However, when I looked on EBenefits I could not find a letter or link that shows the breakdown /stack up of how my payment is determined. I tried showing the SSA the chart from the VA website, but that is not good enough for that side of the government. So my questions are: 1) Has anyone else fought this fight with 2 of the most obtuse government agencies before? 2)Is there anyway to get or generate a letter or some other documentation close to what he SSA is requiring? 3) Is there somewhere on the VA site that shows our payment breakdown, not just the total award, i.e. $xxxxx for 100%, $xxxx for SMC, $xxx for dependents, etc.?
EODCMC posted a question in VA Disability Compensation Benefits Claims Research ForumI have a question that I have been unable to definitively find an answer here and elsewhere. I have an FDC for a couple of afflictions. If, for some unforeseen reason I die of an unrelated issue, will my wife receive the compensation and for how long? Would the answer change if my death were related to my afflictions? I understand that this question assumes I will be awarded disability compensation. iI apologize if this has been answered before, perhaps many times. I'm still working on my "find" skills here on Hadit. No hurry, I have the rest of my life.
I filed for my wife to be added to my benefits 28Oct2014, we were married 18Oct2014. The ebenefits website indicates it might take until August 2017 to approve the request to add my wife. I was told this is normal by the DAV. I asked the DAV for help but they would only confirm that the claim was "pending" in the system. This isn't the first time the VA has had to add a wife for me. The first time only took 10 mins. Today I was told by the VA Rep that everything was in order and it has been taking longer to add dependent wives since Congress told the VA 4 years ago that they needed to improve the process and make it faster. Well I guess they have. Now it takes 2 years to do what it used to take 10 mins. So apparently the VA is lying again. The VA asked for my divorce papers and her divorce papers. They have had the papers for over a year. If the VA is deferring the dependency claims it would certainly make the initial claims look great. But what about all veterans. All claims are important to us. Especially when it concerns money to support the pack. Anybody else with this problem?
FMFDoc77 posted a question in VA Disability Compensation Benefits Claims Research ForumOkay I finally got a decesion letter or actually two for an 11 month old dependency claim to merely add back my daughter that was cut off from my benefits when she turned 18 back in January. She was still in high school and has since moved on to college. The first decision letter was dated 11/15/13 and stated that she had been added back from 2/01/13 to 6/01/13-which was from the time she was cut off in January until the time she graduated high school. The second decision letter was dated 12/19/13 stating she had been added back from 6/01/13 and ongoing. It also shows my new rate which was effective 2/01/13 up until present and ongoing. My question is, I havent received any backpay, even from the first decision letter 46 days ago. They send me these decision letters stating my current rate and even my AB8 reflects what they say but I'm still being paid with no dependents (12/31/13). Furthermore, when inquiring into this via IRIS and sending in a fax to the RO as well, I now see on eBenefits they have opened up a new claim for me dated 12/23/13 titled "dependency - retro pay (New) with an estimated completion date of 3/26/14 to 6/12/14. Can someone explain this to me? A new claim for retro pay? Shouldn't this be part of a completed claim when a decision is made and the decision letter is sent to you stating the effective dates and your current amount? So now I have to wait another possible six months for them to decide on retro pay? I am more than confused. My AB8 reflects I am being paid for my daughter as their decision letter shows but I am obviously still not and again, a new claim for retro pay, and a possible six months to do such?
