Not entirely sure where to post this but here goes, So I am not well versed in the dependent side of the VA, but I am very good at keeping track of my paperwork of what I have received and also sent to the VA. I currently received a full award from the BVA and am just waiting for my RO to make their judgements on everything. When I first left the service I received my initial award two months later (early Va program). My RO at the time was still Winston-Salem, I received a letter August of 2011 asking for my updated dependency status. At this time I was going through a divorce and in September when it was finalized I sent a copy of my dissolution to the Winston-Salem RO (I have copies of this). What I did not realize was that I was still being paid at the rate of having a spouse. I sat down with a VSO the other day and he asked how my wife was and while a bit stunned I simply said I haven't been married since 2011. He informed me that they have been paying me at that rate for 7 years. My question is even though I sent this dependency change, Should I have take other action? I did get on ebenefits because the gentleman said I could check it on there and she is listed under (dependents not under award) but I checked my payment history and sure enough I have been getting paid at this rate. What should my next course of action be in this matter? I don't want them to feel as though I was trying to steal from them and I also don't know what I should do. My BVA award letter even mentions multiple times during my C&P exams that my marriage had ended, this alone shows that I was not trying to hide this from them. Should I show them the extra copies that I sent to Winston-Salem? Below is one of the copies of the letter I sent to the RO in Winston-Salem.

Good afternoon All and Thank you all for your service!I do not have any awards as of yet but for those who do how common is it for the VA to initiate/open a dependency claim while your compensation claim is still active? I submitted a FDC on 1/17/2017 and it included the 21-686c for Status of Dependents. Is this a good sign for potential service connection award for those familiar or working at VA?I was in the USAF Reserves and have been out since May 2012.There was a suspense date for the dependency claim of 5/2/17, asking for a "rating" (assuming associated with my compensation claim), however my compensation claim is still in the Prep for Decision phase in Ebennies.Curious to know if this is a good sign that the VA initiated this dependency claim about 90 days into my compensation claim.Thanks,Shaun
  3. I am currently rated at 10% for tinnitus. I filed for SC for an ankle injury, bad knees and hearing loss in April, 2010. I was SC for hearing loss and pain in knees in 2012 at 0%. I filed my NOD within two weeks of the decision and have been waiting on appeal since. I just had had my C&P for ankles, knees, and hearing on April 14th. I was told by the C&P doc to expect a letter from them by June 14th (60 days). I am not holding my breath. I have a torn meniscus, effusion in the knee, and pain. I have been issued a hinged knee brace for each knee as well as hearing aids. So I feel strongly that I should end up with at least 30% combined, hopefully 40%. My understanding of the retro pay is I should see retro for the difference in what ever combined rating percentage I end up with minus the 10% I already received, going back to the original filing date (4/2010). As I was married in 2009, but can not add my dependents until I am rated 30% or more, will I get retro for the higher amount of spouse and dependents in a second retro payment going back to the original filing date? I get that it will be the final dollar amount with dependents, minus the single amount at the new percentage - the 10% already paid. If my research is correct I should see a first payment of at least $18,671.44, granted I get at least 30%. I got this from: $407.75 (30%) - $133.17(10%) = $274.58 x 68 (months) = $18,671.44 Once my dependents are added there should be second payment of $12,240.00 I got this from: $587.75 (with spouse and 5 kids) - $407.75 = $180 x 68 (months) = $12,240.00 Any information that I am missing would be greatly appreciated.

I voiced concern a few months ago and of course nobody cared. I have erroneously listed two minors- a boy and girl and a 20 yo female. All last names are Martinez. I even have two wives !!   8. This tuition waiver can be used in conjunction with Chapter 35 benefits. We just completed this process for our daughter. Virginia Military Survivors and Dependents Education Program The Virginia Military Survivors and Dependents Program (VMSDEP) provides education benefits to spouses and children of military service members killed, missing in action, taken prisoner, or who became at least 90 percent disabled as a result of military service in an armed conflict. Military service includes service in the United States Armed Forces, United States Armed Forces Reserves, the Virginia National Guard, or the Reserves. Armed conflict includes military operations against terrorism or as the result of a terrorist act, a peace-keeping mission, or any armed conflict after December 6, 1941. NOTE: A Veteran’s 90-100% disability must have been directly caused by the Veteran’s involvement in: 1) military operations against terrorism; 2) a peacekeeping mission; 3) a terrorist act; 4) an armed conflict subsequent to December 6, 1941. The service connected disability cannot have been incurred during active duty that coincides with, but was not the direct result of, one of the listed events/missions. The purpose of VMSDEP is to provide undergraduate or other postsecondary education to eligible participants by providing a waiver of tuition and all required fees associated with tuition at any public institution of higher education or other public accredited postsecondary institution granting a degree, diploma, or certificate in the Commonwealth of Virginia. Benefits are available for up to 36 months. http://www.dvs.virginia.gov/education-employment/virginia-military-survivors-and-dependents-education-program/ To be eligible, children and spouses of qualifying veteran service members must meet the following requirements: The dependent child must be between the ages 16 and 29 inclusively; there is no age restriction for spouses The qualifying military service member must be a current Virginia citizen or maintained a physical presence in the Commonwealth of Virginia presently and for five consecutive years prior to the date of application submission or must have entered military service as a citizen of Virginia In the case of a deceased qualifying military service member, the surviving spouse can meet the residency requirements contingent upon: Having been a Virginia citizen or maintained a physical presence in the Commonwealth of Virginia for five consecutive years prior to marrying the military service member or Presently being a Virginia citizen or maintained a physical presence in the Commonwealth of Virginia and for five consecutive years prior to the date of application submission.   9. I received my initial response back 14 months ago and got awarded 70%. I immediately noticed the paperwork had me listed as unmarried with one dependent and I submitted for married with 3 dependents with all the proper marriage certs, birth certs, prior marriage info and forms required. It's now been 14 months and my dependency claim is sitting at claim received with absolutely nothing done. Multiple phone calls and emails all land me with the same prescripted response of your claim is currently in the works and dependency claims are currently taking xx number of months. The number changed from 8 months to 12 months recently. It is absolutely ridiculous and unsatisfactory that a simple dependency change is still sitting untouched for over a year now with nothing done. This claim was sent by mail in February 2014. I also tried to do one right on eBenefits in June 2012 and I got excited last month when they moved that one to claims completed. When I called I was promptly disappointed to find out they had only moved it because it was a duplicate claim and still nothing has been done on the claim.
  10. On 7/10/12 I filed to update my dependency. My daughter was born on 7/5/12 and my wife and I got married on 7/9/12, at which time I became her son's step-parent. Along with the VA paperwork I sent certified copies of both birth certificates and our marriage license, all certified mail. To date my claim is still pending; the "help" desk acknowledges they have all three documents. I have sent letter, after letter (again all certified mail) with no response. How much longer should I wait before raising a stink? Most of what I have read says not to bother involving my congressmen, but with my initial C&P I was having the same problem. I sent letters to my state's senators and congressmen in Washington, as well as in Tallahassee, along with all the Congressmen and Senators on both Veterans Affairs Committees, and my C&P exam was mysteriously scheduled less than a week after receiving phone calls from 10 elected officials in two days. It amazes me how long the VA can drag out looking at 3 pieces of paper.

I have been designated a service connected disability rating of 40%, and need help completing VA Form 21-686c - specifically Question 13 'How much do you contribute monthly to your spouse's support?' Do I enter '100%' as she is disabled with CA lung, airway disease, essential tremor & Parkinsons, and bipolar disorder - so she takes up to 15 meds. Or do I need to enter the average monthly energy bill, grocery bill, her medications etc to get to a $ figure? Many thanks - I appreciate all the help I can get. . adwyer
  12. I started my claim 14-Sep-1010 I was completed and rated 17-Jan-2012. I have been rated at 100% and recieving compensation. That is good I am happy about it. When I got my rating my dependents had not been included so I filled the paperwork out and sent it in. During the last 7-8 months I have waited and not heard anything from VA until last month. I talked to a lady on the phone, and she said that the claim I filed 14-Sep-2010 was still pending and that I just needed to be patient. I told her that was not correct and explained to here that I already had been rated and that I had recieved my confirmation letter. She looked in the computer again and said oh ok, so what is the problem? I explained to her that I was trying to ad my dependents and that I had sent in birth certificates and my marriage license. She told me that she would call me back. That was a month ago. Well this morning she called and left a message telling me that my claim that I filed 14-Sep-2010 had been completed as of today. She also said in the message that my claim for dependents would be processed at this time. She then after that said that she did not have an answer for me as to when I would be recieving my compensation because it had to go the approval department/office. I was blown away by all of this. I logged in to E-benefits and sure enough right there plain as day that my claim is pending. I look in my payment history and you can see where I got my back pay and where I get my compensation every month. So what I am now worried about is that they are going to kick my rating back or worse yet my compensation may be interuppted until someone can figure this out. I have been trying to call the lady back so I can find out what the deal is, but the number she called on only offers me a directory I cannot access. If anyone knows what is going on that would be great. All I was trying to do was add my dependents and get them some health care.
