  1. My apologies in advance if this question has been asked before. I searched the site and could not find the answer. I am 80% but rated at 100% IU. 70% PTSD and 30%Recurrent Shingles I want to try working again as I have difficulty maintaining employment due to my PTSD. My Psychologist and Psychiatrist also suggested that I try working again as well as it may improve my mental health and assist in me overcoming anxiety and social phobias. I've lost 5 jobs in the last 11 years due to exacerbation of my symptoms. I will be requesting an ADA accommodation due to my PTSD. (I have been applying for a position at the local VA hospital. ) I am a Registered Nurse and I usually make a descent hourly wage. Does an accommodation under the ADA qualify as employment in a protected environment?
  2. Hello, I hope everyone is well. Does anyone have any experience or knowledge regarding Federal Government Title 38 employees (Professional Healthcare worker such as RN, Physician, etc.)? Has any veteran experienced difficulty in obtaining employment at the MEDVAMC in Houston, Texas or any VA facility? If yes, do they feel that veteran status had a negative impact? Who else should I contact in order to file a grievance against the Title 38 veterans preference exemption? I have a Masters Degree as a Registered Nurse (Nurse Practitioner) and I am interested in seeking employment at the MEDVAMC in Houston, Texas. I have applied at the facility for more than 8 years without success. I am greater than 50% Service Connected. Registered Nurses and other healthcare professionals are considered "Title 38" employees which means that we cannot use Veterans Preference when applying for jobs at the VA. I am board certified as an Adult Gerontology Nurse Practitioner, Adult Health Clinical Nurse Specialist, Critical Care and Wound Ostomy and Continence. I wrote the Secretary of VA and inquired as to why Title 38 employees are exempt from veterans preference and my letter was forwarded to the Director of HR in Houston, TX. I asked her to explain the reason military veteran RNs and other health care professionals cannot use veteran preference.....Her answer because the VA only wants the best qualified candidates. My question to her was that if a veteran is qualified to be a commissioned officer in the military as a Registered Nurse why are they not considered among the best qualified to work in a Veterans Hospital? I also asked to know the qualifications of Nurses and Advance Practice Nurses that were chosen instead of me. Her answer was that hiring was strictly up to the hiring manager. I have nothing against foreigners (several of my in-laws are foreigners) but all of the hiring managers that I interviewed with were foreigners--Filipino, East Indian, and/or African. The staff nurse interview panels were always completely homogenous either all Filipino, East Indian, or African. I feel that by exempting Veterans from preference there is a possibility that Veterans may be inadvertently discriminated against due to their Veteran Status. The reason I say this is because at every interview the hiring manager or panel come across as 'skittish' or 'unsure' when my military service is illuminated. I asked the HR Director how many nurses at the facility were military veterans? Her answer was approximately 6%. She could not provide any information on how many of the 6% were in leadership positions or hiring managers. I wrote both of my Senators this past summer (Ted Cruz and John Cornyn) regarding the Title 38 exemption for Veterans Preference. I feel that RNs, Physicians, and other healthcare workers should be entitled to Veterans Preference. I received no response from Ted Cruz. John Cornyn's office thanked me for my service and gave some generic response on how they supported veterans. Congressional Veterans House and Senate members, the ones that make laws, do not provide responses. I know illuminating race/country of origin is a sensitive subject for some people. If my letter is coming across as brash, abrasive, or offensive that is not my intention. I am primarily concerned about the possibility of being discriminated against due to my veteran status not race or natural born citizenship.

My 2nd go-round I got a bit smarter and claimed MDD, Tinnitus, I/U, ADD with bipolar disorder (2ndary), and Anxiety Disorder. Claim submitted May 15 2016. Just did C&P on July 23 2016. The following is going to be info from my VA records, and I'm scared I did it wrong again - currently in a homeless vet program and sick of being broke/retarded at life. No combat tours. Assigned to a recruiting station, a decade younger than every other Marine in my office. Was often critized for mistakes in job performance. Sometimes I would take breaks and cry in my car because I was so unhappy with that present situation. Sept 2007: Talk to a psych once 2 months before discharge about my emotional issues and depressed state. No diagnosis. Sept 2008: Diagnosed with Depression. Was taking a med called Citalopram or something. 5 days later had a suicide attempt and was in the VA ward for 3 days. Was officially diagnosed with MDD less than 1 month after I left service. Now: Went for my C&P for Tinnitus. She said I had high frequency hearing loss. They didnt provide me hearing protection (ran out) during grenade throwing which was initial issue. It effects my sleeping and sometimes have to have people repeat things. C&P for MDD: Explained what I have above about my final duty station, my suicide attempt. Also added: 10 years of not being able to hold a job, quit/get fired for stupid reasons, dont show up cause I dont feel right. I lay in bed for weeks at a time not feeling like doing anything. I DO take care of my appearance. Feel hopeless and useless to society Cannot make functional relationships with others. Distrust others automatically. Avoid others at all costs. Hear voices saying 'its ok to die, the world doesnt need you,'. Will continue updated once I re-log on this library computer. What do you guys think/predict/belief?

For that matter, the word total doesn't mean total when discussing a disability. These are just terms to VA. There really isn't a protected rating. Any rating can be modified by VA at any time, depending on the circumstances. How do you know if your benefit is P & T? What is IU? What is substantially gainful employment? Are there any other eligibility requirements? How is the way VA decides total disability different from other agencies? TDIU awards may be permanent or they may be temporary. If I get a 100% rating, should I continue fighting the VA for benefits?   7. Hi! I'm new to the forum and have a question about IU. In June 2010 I filed an appeal for an increase on PTSD, low back condition, hip condition and IU. In Jan. 2012 I was granted an increase on PTSD from 50% to 70%. I now have a combined total of 80% (70% PTSD, 10% each on three other conditions). The decision on the low back, hip condition and IU was deferred because they need additional information or evidence. I received a letter dated 3/29/16 that stated that under DeNovo Review a "Rating Decision dated March 24, 2016 granted Entitlement to Individual Unemployability and Basic Eligibility under 38 USC Ch 35 from June 20, 2010. As such, this issue has been removed from your appeal and you will receive notification of this decision in a separate letter." I guess my first question is this: From what I am reading, it is my understanding that I have been granted P & T IU with retro pay from June 20, 2010. Is this correct? My next question: Does anyone know how long it usually takes before I receive the decision in the separate letter, as stated above? Final question: How long does it take to receive retro pay? Thanks for any help.

Individual Unemployability (TDIU) or (IU) Fact Sheet Individual Unemployability (IU) is a part of VA’s disability compensation program that allows VA to pay certain Veterans compensation at the 100% rate, even though VA has not rated their serviceconnected disabilities at the 100% level.
