  3. Many may not be aware that one can request that a Aid and Attendance claim CAN be expedited when showing that you have been diagnosed with a terminal illness when you file your Aid and Attendance claim. Long story, short version: I have been on the non-service connected pension which currently is $1,072.00 per month. In April of 2016 I was diagnosed with Stage III B terminal lung cancer. i then needed to file a claim for Aid and Attendance for help with my daily needs. Which is an additional $716.00 per month. I was worried about how long my claim would take to be approved/denied. After doing some research I learned that when filing a Aid and Attendance claim while having a terminal illness that one can request that your claim be expedited due to that terminal illness at the time of filing your claim. Because of requesting my claim be expedited due to my terminal illness. My Aid and Attendance claim was processed and approved in 26 days and I now receive an additional $716.00 per month which I now receive $1,788.00 vs. $1,072.00. I truly hope this will help others who have a terminal illness and need the extra Aid and Attendance income as soon as possible who may not have been aware of any expedited claim processing being available to them. God Bless Don
  4. Hi, I started receiving death pension benefits through the VA in 2009. March of 2014 the VA terminated said benefits. i neglected to respond to their notices of an alleged overpayment in the allotted time frame. However i did in fact follow through with a notice of disagreement, request for hearing and a waiver request. The waiver request was eventually granted at which time i reapplied for the death pension which has since been reinstated. During the 10 months that it took to resolve this i was financially eligible to receive the pension. The VA agreed and sent payment for those 10 months, however it was at a reduced rate. As are the monthly payments I now receive. VA sent a letter stating that by law they were required to collect the overpayment... My questions.. Is that not what a waiver is granted for, to waive the repayment? And before withholding any part of the reinstated pension should i have not been considered for the hearing i requested? Or the NOD i submitted to argue the amount the VA claims I was over paid.? Thanks for you help. Debra.
  5. Hello, This is my way of introducimg myself to the Hadit community as a whole. I only surf forums and give opinions and such to things that relate to me personally and my Battle with the VA I wanted to get not only all of these tags talked about, but i would hope to be able to at least get all of those abbrvs broken down for the people that come to this site in need I have noticed a lot of us old hats talk to each other in a comfortable, approachable, yet sometimes maybe even un-understandable to those who aren't in our War with the Rap-i um, mean Rating Officers Some of the people stopping by here for well deserved and needed help may not even be Vets, but their Spouses, their guardians, and most Unfittingly too often their Widows I hope to try to build a little list, where if someone came here, they would have, oh, lets say a nice rusty ass old anchor to grip on to, you know, to help them ride out this Hellacious Hurricane of a system we face Add any word, phrase, Article or Chaptet number of any Law, Rule, Regulation that you would like to help pass on, well, not only the cold logical definition, but tye way it helped you in YOUR Battle. i want this thread to be open and honest, but please, don't get lost and sidetracked trying to impress the community, if a discussion blooms from seeds planted here, take your conversation to the Mail system, and coax them to sproutlings on your own dime, and come back with your Harvest of Ideas. Only we have each other, as i have stood on my own for this last 2ish years, i have wanted something more Here, there be monsters, hide no truths, hedge no bets, the deaper we are able to cut on here, the finer and more powerful Claims we can make. Always remember, we should be advancing, and when i steped into Hadit, i started to feel something different on this Battlefield, ever so softly, in the muck, my arm tired from holding back the Tide of VA bullshit... I felt a small click on my shield, it was YOU! You and I, we began to share the load, gave us both second wind. And slowly, i realized what T-Bird has done, he has started a Cadence! my Shield-Brothers and ShieldSisters. Every one of you, whose words i read, eased my burden. The VA can only xxxx us as individuals. Remember, nearly a hundred years ago, when people REALLY figured out how democracy can work for the minority within the majority, Prohibition was passed, and that is because of Soldiers of Ideals. Our issue is, the VA makes us literally be the David to their Goliath. They demand that we beg for our scraps. Very few Vererans are in the position to demand their Just Compensation because first off, we are broken. Assailed by disabilitys they expect us to fight. Alone! They punish us horribly with Time, and indifference......they teach us to Hate the individuals in their system, Whistleblowers ignored except when it boosts Ratings yet never allowing us Veterans ourselves the ability or TOOLS to help OURSELVES. i dont want someone coddling me, i can repair my own engine given time and proper tools. No way in Hell am i gonna try to pull impacted lugnuts off with my teeth now am I? 7. Well, I filed (for the 4th time across 28yrs) for my spine (Spondylolethesis) and depression back in November 2015. In May of this year, I got the letter - 70%. I am thankful but I had questions about backdating to the first claim I filed for my spine which was in September of 1988 (I also had applied in 2001 and in 2006 - denied each time). They had failed to consider the MEB and PEB findings the previous 3 times, which they had access to (National Archives), and ignored my DD214 which stated "discharged with severance pay." My C-file clearly shows the original application dated to 1988. What are my options here?
  8. A friend is receiving $3,000+ for being rated 100% P & T. He is married but maybe looking at divorce in the future. Will his wife receive half of his $3,000+ in the event they are divorced? Thanks
  9. I recently met a Korean vet who is 83 years old and is in a wheelchair. He was in the military from April 9, 1952 to Sept. 18, 1954. His disability is not from combat although he did have hearing problems from his experience with heavy artillery. He is able to use the VA hospital because he has his honorable discharge papers. This vet has asked for a pension because he spent time in Korea in 540 Company, 8th Battalion . His combat records were destroyed in the 1973 fire in Chicago. He has been told he can't have his pension because he can't prove he was sent to Korea. At his age it will be difficult for him to fight the VA for his pension so I'm trying to help him. Can anyone help me help him?
  10. I am currently receiving the NSC pension I didn't even know anything about it until early 2011 it took me only six month to get the whole process done. I got a letter in the mail today saying that I could not add my dependents because I didn't have a rating of 30% or higher. It took the Va since last year Oct (when i filed for them) to tell me this and send a letter. Can some one shine some light on this. I didn't know I need to have a service connected rating of 30%. Currently my service connected rating is at 0% and I do have appeals in the system so i can get a higher SC rating. When I received the award letter for the pension it said that I needed to submit my dependents info and now months later.... I hit a brick wall :(. -----------------------------------------------------NSC pension--------------- Also to get the NSC pension which I am receiving it says In addition to meeting minimum service requirements, the Veteran must be: Age 65 or older, ORTotally and permanently disabled, OR A patient in a nursing home receiving skilled nursing care, OR Receiving Social Security Disability Insurance, OR Receiving Supplemental Security Income --------------------------------------------- Here is a link to where I have all my info about my current situation if anyone wants to help. /index.php?/topic/51620-need-help-with-claimall-info-inside/?hl=chrome_305#entry303540" rel="norewrite">http://www.hadit.com/forums/index.php?/topic/51620-need-help-with-claimall-info-inside/?hl=chrome_305#entry303540
