  1. In 2017 I received my award letter and it stated that I was tdiu permanent and total with no future exams. Since then I have never received anything in the mail from the VA asking whether I'm working or not or earned any income. I got curious about this and read up on a few posts that they now verify if there's any earned income through Social Security and IRS. My question is in 2019 I earned $600 helping an elderly family friend around her house. I cleaned her yard, cut the grass and things of that nature on the days I felt well enough to do it. It was an hour here and there. The total for the year was 600. Well now fast-forward to 2020 it's tax time and since I earned $600 I filed that on my taxes under household worker. I did not realize that I was not required to file taxes under a certain amount of earned income. Nevertheless the taxes have been filed and now I'm worried that this could compromise my tdiu permanent and total status even though I have read up on marginal and or gainful employment criteria and the 600 earned is way under the poverty threshold. I guess most of the worry comes from the conflicting information I read on posts some say that if you make under a certain amount of money under the poverty threshold and are not involved in gainful employment or your employment is marginal then you really don't don't have anything to worry about. On the flip side I've read plenty of post where people say if you work and income is reported you'll be electronically flagged and lose your tdiu so I really need some help and guidance please on how this could affect me and what I should do if I receive something in the mail from the VA.
  2. Can't believe that I'm 100% Permanent and Total. With VA jerking me around for all these years, but without the help from Hadit I wouldn't be here. The fight continues at the BVA level to hold on to what I've got, but now I can rest a little easier. The property Tax Exemption and the free Dependent Tuition is what my injuries deserved and that is what I was pushing for. I've seen Rheumatologist, Podiatrist, Vascular Surgeons, General Doctors, VA Doctors Nurse Practitioners, combined, with hundreds of pages of medical evidence along with buddy statements to help solidify my case.   3. I know that I qualify for the program by just reading the requirements but qualifying is a different issue. If I am using this program to get management of my daily living with my family, is that a denial when they see my PTSD and sTBI have been made Permanent by the VA for the rest of my life?

Hello, I'll go through this in chronological order: On my initial determination letter for 100% rating (May 10, 2011) it says "An examination will be scheduled at a future date to evaluate the severity of your service connected "PTSD". Further in the letter it states, "The examiner indicated that you would benefit from counseling and other mental health service, therefore, there is evidence indicating a possibility for improvement" The assigned evaluation is not considered permanent and is subject to a future review examination". So, I submitted another application for increased determination, for P&T (August 31, 2013), and received a determination letter (October 29, 2013), stating: 1. "Evaluation of PTSD which is currently 100 percent disabling, is continued". 2. "Eligibility to Dependents' Educational Assistance is not established". (Indicating that it's not P&T I'm thinking). So, I called the VA phone number and asked for a letter so I could receive base access and MWR privileges. I received the following letter: "We are giving you this certificate so you may receive commissary store and exchange privileges from the Armed Forces". "This is to certify that xxxxxx is an honorably discharged Veteran of the Army and receives benefits at the 100% rate". I was able to obtain a Base ID Card (DD Form 2765) using this certificate, which I thought required P&T Status to obtain. Sp now, I've gone onto the MilConnect (www.dmdc.osd.mil) website and when clicking the 'my profile' tab I see the following information: Persona Type: Disabled Veteran Disability Extent: Permanent and Total Disability Begin Date: 08-21-2013 I am trying to figure out where exactly I stand. Am I P&T? Am I not? Is my spouse eligible for CHAMPVA? Any assistance is deciphering all this will be appreciated. - DESERT
  5. Am I exempt from future C&P exams if I'm P&T? I am P&T, 80% SC, and TDIU. I just had one C&P yesterday and am scheduled for another in one month. I asked my VSO about the exam and he said the VA was just getting a benchmark on my health, tracking my disabilities for future reference. I received a letter today from DVA regional thanking me for my service. The letter noted my claim #, dates served and honorable discharge, and gave my VA information. Sevice-connected: Yes Combined service-connected evaluation is: 80% Effective date of last change: 1 Dec 2011 Current monthly award: $2,924.00 Am being paid 100% because I'm unemployable: Yes I am considered to be totally and permanently disabled due to service-connected disabilities: Yes I just had a C&P exam yesterday for sleep apnea possibly secondary to CAD. Also, the exam covered DMII. I had a C&P for DMII in 2010.
