I recieved this email yesterday morning on status of bva granted awards for ptsd,sleep apnea and flat feet.My claim was filed 3/6/2012 I received the bva grant of appeal on 5/4/2018 and have yet to recieve my new rating of 100% with smc-s or my retro pay.I was told while they figured out my attorneys fees the first time they forgot to add the cola for each year,that prompted a redo.Does anybody think this email means I'm getting any closer?
  2. Hi everyone, So I thought I would see if I can get an answer on this. So I got out in October 2011 and had a C&P Exam 5 days later where I got denied on a SC Condition. I reopened the case last year in July, denied again because of no new evidence. This year, reopen the case again, no new evidence but given a c&p exam and was rated at 10% on it. Now, should the effective date be from my original C&P Exam where I got denied, or from 2017?
  3. DAV told me there is no expediting claims anymore even for Vietnam Vets. Only terminally ill vets, homeless, or going to be homeless are expedited, so it took DAV 5 months to get my claim into the system because they trashed it the first time because they are a corrupt organization. Mr. Edwards in St. Louis for DAV got Mr Stephen Kelly his 12 years of retro pay in one week without even filing a claim, the way I read it. Dan Knabe For DAV got Mike Franko’s claim “Expedited” after he had been denied once already, also got him service Connected, got his retro pay, and got him a job with DAV as well. There was no mention of homelessness, or illness besides ptsd and knee injury. Mr Kelly was just before me and Mr Franks was just after me and none of us fit the requirements except Mr Kelly and myself were Vietnam vets, and Mr. Kelly and Franko were Gulf War Vets, as best as I remember. I was permanently damaged by something affecting my entire internal body and skin(AO), and records hidden all my life. Edwards and Knabe got their clients records, scoured through them, and completed and closed the claim in one week. The VA is still withholding my records, I have used a VSO (now VFW) for the last four years, and still waiting. VFW told me it would be at least 3 or 4 years before the BVA gets to mine. Minimum 3 to 4 years, and I probably won’t even exist by then. This sounds like picking and choosing who is expedited, which is nepotism or being prejudiced against my claim. I filed in 1983 because the Army lied about my records in 1972 or I would have filed then. Total manipulation to keep me from Justice per Exemption 5 of FOIA. Any recourse? Is a malpractice suit the only recourse, unless they make it right with this last attempt? Thank you! victor ray
  4. What's up Fellow Vets, I have a question about back pay. I was medically discharged from the Army in 2004. In my VA paperwork, prior to discharge, I claimed my asthma ( which I am 30% sc) and my left hamstring stains. I was approved sc for my asthma (30%) but my the claim for my leg was denied because they said it wasnt a chronic. Since my discharge, I have re-injured the same hamstring at least 2 times a year. I am currently receiving physical therapy for the same hamstring at the VA hospital. I noticed on Ebenefits that my claim for my leg was still there waiting to be reopened, so i clicked the option to reopen my claim. Do you think I have a case for my leg? If so, do you think this will qualify for back pay since the original claim was filed in 2004? Thanks for the advice.
  5. I am a still confused about retro pay. Currently I am rated at 80% I just received 70% in may 2017 for depression with an effective date of May 2008. I had been rated at 40% with 30% for pain, 10% for tinnitus. I had been receiving $651 from the VA with the Navy taking away $651 every month. I understand this to some degree. I think? My question is will DOD- pay my retro pay? I received $470 payment from the VA for some reason last week. Will I get the 80% payment back to 2008? Thank you all for your time here. I am tried frustrated with this claim. Always darkest before the dawn I hope.
  6. I recently received my award letter for TDIU and it was made Permanent and Total. I want to thank all of you for your kind advice over the years and teaching me about how I should approach my claim. It has helped in many ways, especially letting me know what to expect. I filed a notice of Intent to file in February 2016 and submitted my claim in August of 2016. In calculating the back pay, they went back only to August 2016 and not February 2016. They said in the letter that since I left work in February 2012, they would only pay me from the date that I filed the claim, August 2016, since I did not file within a year of leaving work. I don't think that is correct and think they should go back to February 2016 when I filed the Intent to file. I just want to make sure I am right or they are right before I formally question that date. My next question is: Since I am rated TDIU and Permanent and Total, should I file Secondary Conditions. I am rated at 60% and have had that since 1994. My concern is that if something happens to me that my husband will be able to have some money coming. Again, thank you for helping me over the years.   7. back in 2011 I filed for a plethora of disabilities that i received during my time in the air force as a load master. I was given an 80% rating. One of the claims was for depression an ptsd. However, I missed that c&p appt (i forget everything) and i obviously was not given a rating. However, I was sent a letter that says: "You were denied service connection for depression/anxiety/stress because you did not report for the scheduled exam in order to determine if the current disability began on active duty and to obtain sufficient information for evaluation of the disability. Although there is a record of treatment in service for anxiety/depression/stress, no permanent residual or chronic subject to service connection is shown by the service medical records or demonstrated by evidence following the service." Now this was sent to me in 2011. Since then ive received a ton of treatment but ive also have had some unfortunate events happen as a result of the depression, anxiety, anger etc (jail, a stint at the mental health clinic, even a broken hand twice on two separate occasions on 2 separate faces, and few more incidents. i am working so hard on controlling my frustrations with the world and i am taking my meds and getting counseling - i hate living like this because i physically cant control it. And i was never like that prior to 06' my join date). so my question is what exactly does that quote from the va mean? does it mean that they recognize i was treated for depression during active duty but due to me missing the appointment, they need more information? And if i were to file a claim for depression and ptsd - and i were to receive the 80% I need in order to be rated 100%, how would the back pay work? Would the date go bak to my initial 2011 date? Or would they back pay me from the current date of filing? Sorry for the long post - thanks for the help. Also am i correct in saying that they would only be paying the difference between the 80% pay and the 100% pay right??

    I would appreciate some opinions on courses of action. I received the brown envelop on Oct 12 on a claim submitted in July 2010. I was awared TDIU and my rating increased from 80% to 90%. The letter explained the withhold for the DFAS audit. Called DFAS and was told that they had done the audit and forwarded it to the VA in January 13. In Mar of 13, saw in the ebenefits that there was an administrative review that decreased one of my SCs from 20 to 10 without changing my overall rating and I received the corresponding letter stating that as a fact. I have been waiting for the retro and the DAV keeps telling me that I am in line. In April, the ebenefits posted an authorization review and said that a decision letter was sent and that appeal was possible. Nothing in the mail at all so far. Still waiting for retro pay. Any suggestions? Thanks.
  9. Okay I finally got a decesion letter or actually two for an 11 month old dependency claim to merely add back my daughter that was cut off from my benefits when she turned 18 back in January. She was still in high school and has since moved on to college. The first decision letter was dated 11/15/13 and stated that she had been added back from 2/01/13 to 6/01/13-which was from the time she was cut off in January until the time she graduated high school. The second decision letter was dated 12/19/13 stating she had been added back from 6/01/13 and ongoing. It also shows my new rate which was effective 2/01/13 up until present and ongoing. My question is, I havent received any backpay, even from the first decision letter 46 days ago. They send me these decision letters stating my current rate and even my AB8 reflects what they say but I'm still being paid with no dependents (12/31/13). Furthermore, when inquiring into this via IRIS and sending in a fax to the RO as well, I now see on eBenefits they have opened up a new claim for me dated 12/23/13 titled "dependency - retro pay (New) with an estimated completion date of 3/26/14 to 6/12/14. Can someone explain this to me? A new claim for retro pay? Shouldn't this be part of a completed claim when a decision is made and the decision letter is sent to you stating the effective dates and your current amount? So now I have to wait another possible six months for them to decide on retro pay? I am more than confused. My AB8 reflects I am being paid for my daughter as their decision letter shows but I am obviously still not and again, a new claim for retro pay, and a possible six months to do such?

    Hello family, I have a general question regarding retro pay. How is it calculated? Do they pay the vet the difference of the combined rating of his total claim, or is each individual claim assessed on its own merits and compensated back to the date it was originally claimed? I'm confused because suppose a vet was at 70% combined. Then files a claim or reopened a claim for PTSD and tbi. This vet had been previously denied service connection for these two. Then he is awarded 100% sc. Now will the retro compensate him for the difference between the combined previous rating of 70% and the new 100% combined rate? Or would he be retro paid for each individual claim, that is to say PTSD and tbi separate and distinct from the total. Now in my math compensating him for each individual claim sounds like a much more favorable outcome that using the total sum formula because the former adds up to significantly more, I'm just not so sure the va pseudo math works the same way. As always, I appreciate and am grateful for all educated and generous input.
  11. 80% to 90% Married w/1 child + 3 dependants Granted 17OCT Retro amount-926 Amt direct deposited this AM (Memo) for 1APR - 1875.00 Shouldn't it have been at the new rate (2109.00) and not the old rate? Retro would have covered Dec, Jan, Feb (Oct doesn't count, Nov, Dec, Jan pay) and 1APR would be the start of the new rate, right?
