  1. So, have been appealing TDIU claim and unsure as to why they keep denying (waiting to see on BBE) but I am about to file an almost sure thing secondary claim for my other knee. Based on my ROMS and things, it seems I should receive at least 30% if not higher. Between that rating and bilateral factor, that would put me at 100% schedular. The thing I am wondering is: If I get the 100% schedular, does that now make my TDIU claim moot? It has been about a year since I started the TDIU claim so I would hate to lose back pay. But, I am unsure how this would work? Any one have this scenario before? I feel like its still a separate claim.
  2. Right then, for reasons I can't grasp, Confusedvet1 started a thread that I am unable to comment in. Regardless, most of us know and understand how the retro pay works. However, some will feel that the pay should be based upon current rates and not historical rates. It is an understandable thought or concept, however incorrect. Simply the term 'retroactive' alone defines how the pay would be calculated. This offers a good example in everyday situations. The VA offer nothing regulatory regarding how retropay is computed. I've also looked at DFAS and DoD 7000.14-R (Financial Reg) as well as within other government agencies and departments involving the military (AD, RES and Retired), but there is very, very little. I have, however, found some other links that will prove helpful. This offers some examples, but sadly without regulatory or law citations. 5 USC, § 5596 (b)(1)(A)(i) (Law) Also... 5 CFR § 550.805 (Regulatory) While both of these are directed more towards civilian and not military, keep in mind that the US Government works nearly the same across the board in numerous areas. A GS12, step 6 will receive the same pay regardless if FBI, DoE, DoI, etc. Contracting is the same for all US Government agencies and departments and are covered by the FAR. It therefore stands to reason that back-pay or retro-pay is going to be handled and treated the same throughout the US Government regardless of agency or department.
  3. Hello, first time posting here, thank you to everyone who has posted before me. I received a grant for my BVA hearing on April 15, 2021 and I received the letter in the mail. I was granted an earlier effective date for unemployability for about a year and a half so I should get some retro pay. So I received the letter in the mail dated April 15th and on May 8th my Ebenefits updated under additional benefits tab showing the earlier effective date however there is no retro pay. Has anyone had any experience with your ebenefits being updated but no retro pay yet? How long am I looking at? Thank you again whoever can share some experience with BVA grants.
  4. Hi Hadit community, I am looking to see if anyone has had payments for a claim that is still open, gathering evidence, and still has physicals and appointments yet to complete? I received a VACP deposit this morning a little over 2k, Submitted claim 11/2019 - Completed the 1st physical appt for hearing loss in early Feb 2021. Still have a lot of items open which have yet to be addressed on this claim. Did see the Retro Claim payment info on the va government site and waiting on the explanation letter. But I am at a loss because I thought you didn't get payments until a final decision was made on your claim? Just wondering if they've just started paying what they've ruled so far while scheduling the other appointments? Or just shut it down with what looks to be 10% and not schedule any other appointments, while the site updates from open gathering evidence to 'closed and final decision'? Which would be odd because there are clearly items that need to be addressed with appointments yet scheduled. Thanks all.
  5. At what amount, does a claim in Higher Level Review, have to be sent to be approved by someone else?
  6. Hello All, After a 7 year wait, I won my VA appeal. The problem is my new rate (1 July) and retro pay are calculated by the "Veteran Alone" rate. I have a spouse and child. I checked Ebenefits and the dependent status is correct there. I'm not sure how a mistake like that can be made. I called the 800 number which was a waste of time. A rep from IRIS was able to take action. She said she would send a notice over to the "Dependent Dept." Has anyone encountered anything like this? Is there a way to follow-up. How long should this take? I can remember it took a year for VA to add my spouse. Any assistance you can provide is greatly appreciated. Thanks for your service!
  7. Hey all, I recieved news that my increase claim was granted and I went from 60% to 100% On my ab8 letters it says the date changed is may 20th, with an effective date of june 1st. Does this mean I'll receive the backpay for june and july?
  8. Quick question, my appeal was approved at 100% with eed. After having letters updated, how long does retro pay take to hit? I have heard up to 6 months? And seen people saying as little as 2 weeks? Edit: this is a NOD, at my regional office. Edit 2: my NOD was for an increase, and it was granted to 100%. Which, like I said, is reflected in my letters on ebenefits correctly at 100%. The letters updated last Thursday. Not sure what to think. Thank you all for your help
  9. So after waiting an entire year, two of my four claimed disabilities went through, and they gave me a rating of 40%. The other two conditions went back to gathering of evidence, but I'm curious if I will get back-pay for the 40% as of now since I have already waited an entire year. Has anybody else gone through this or know anything about it? I've been reading very conflicting information.
