  1. I will apologize in advance for the lengthy message but I am looking for insight on what may be happening here. Dec 2019 I filed claim for CCCA - which is a progressive alopecia typically found in certain group of women and very specific symptoms. I combed STR and found first instance of it in 2003 while active duty. I was treated over the years but it progressed (nothing you can do to stop it only slow it down). Based on disfigurement criteria I believe that my records, statements, etc. met at least four of the requirements. Last 3 years I had been treated by dermatologist and this was her specialty. She wrote medical opinion and completed DBQ (although not correctly) as she had done this before. I submitted STR, civilian treatment records (over last 10 years), statements(my own, a battle buddy while active duty, hairstylist when active duty, and current hairstylists), and color photos on Dec 2019. I had CP Exam with VA contracted NP in January 2020. We talked she measured and “agreed” or confirmed that she saw what I saw. Within 30 days of my initial submission, I received rating indicating 3 of 4 had been met additional they described the wrong location (back area of head not middle/front). I filed HLR with conference. I had conference on day 123 and he asked what did they miss? I asked should I give you page numbers of submitted docs to support criteria #4? He said no that’s my job. He also said if criteria not identified in CP Exam then not given weight. Result on Day 125 continue current rating. I then filed a supplemental claim, submitted additional doctors records (last visit had not been submitted), the DBQ that my private doctor completed in Nov 2019 (with color photos)and two additional statements(mine and spouse). I have now received request for another CP Exam. Is this typical? Anything I should consider? I tried to lay out all of the pieces. Is this CP Exam another opportunity? I am prepared to go to BVA - as I have done my homework. Seems like the CP Exam was given significantly more weight instead of total picture presented. I requested January 2020 CP exam and opinions in February 2020 ebenefits shows available 5/2021. @Berta @Buck52 @broncovet @Tbird
  2. Hi Everyone, In my most recent C&P the examiner noted and measured 2 scars on my neck and jaw. I've read the rating info for scars of the Head/Face/Neck and filled in the chart they had because the first rating option didn't apply. Can someone confirm for me that according to the rating info below, it would qualify me for 30%. There's pain noted in the C&P with each scar in addition to the characteristics noted below. "If there are 6 or more Characteristics, it is rated 80%. If there are 4 or 5 Characteristics, it is rated 50%. If there are 2 or 3 Characteristics, it is rated 30%. If there is 1 Characteristic, it is rated 10%." In addition, during the same C&P the examiner documented and agreed (50% more than likely service related) that I had TMD secondary to broken jaw, painful motion of mandible, reduced ROM, surgical wire in right mandible Thanks in advance!   3. Hi everyone! Hope all is well. I just wanted to stop in and say hello. I haven't been on here since late last year. Life is going good. As most know my story and it was a doozy, I finally got everything I deserved! Overall 90% and I couldn't be happier. It took a lot of hard work and sleepless nights and a lot of C&P exams and fighting the VA but I prevailed. I was thankful for this sight b/c without it I would have never met a great guy that helped me with the final phase of my rating. I am now just waiting on an EED for my contentions but I am really not really worried about it and if it happens great and if not, I am good. Don't give up EVER!
  4. Recently I had a C & P for my feet, (currently filed a NOD). While there the doctor asked if I ever filed a claim for my lipomas. Said I didn't know I could. She called me the next day explaining they clearly started on active duty and to file a claim for skin, scaring, and multiple lipomas. Two weeks ago I drove an hour to my C&P exam where the doctor took pictures and measurements ect. Today The doctor called me saying there was a mix up and she was told to remove the dercums diagnosis from the report and don't report on the lipomas, only the scars. Now I might have to go back as they want photos and measurements of all scars not just the 3 that are problematic. My issue is they are telling the doctor to remove a diagnosis and exactly what to report on and not report on. I doubt they would concede on anything. The skin was the dercums, scaring is for the problematic scars, and the multiple lipomas referred to the massive deformity of my thighs. ( I have between 150 and 200 lipomas). Any suggestions/ideas? I wish I could call them direct to find out why they are ignoring the diagnosis.
  5. So on Monday I had my C&P exams for my feet/ankles/toe and scars. I think it went rather well and the doctor was thorough. These C&P exams were ordered on September 8th, 2016 by the DRO in WACO after she over turned the other DRO's decision. She ordered the C&P exams so I could get a proper rating on my contentions. She over turned the DRO's decision due to his egregious errors in my decision that I brought to the attention of Mr. Robert McDonald's office and my local Congressman. After getting the representative from McDonald's office to contact me and then to get the WACO office to contact me, I sit here today awaiting the decision I should have had years ago. I am grateful the new DRO reviewed the decision that the previous DRO made and over turned it. The DRO that made the egregious errors in my decision has apparently done this to other Veterans. I hope they investigate this DRO. I am thankful I did not have to go another 2-4 years to the BVA to appeal a decision due to the egregious errors by one DRO. I am grateful the new DRO assigned saw the egregious error and reversed the decision at the RO level. I did talk to the DRO on Wednesday and she said she received the scar C&P exam but not yet received the Foot/Ankle/Toe C&P exam. She said it shouldn't be too long and then she can rate me. I am so anxious right now!
  6. Hi there everyone, I'm a newbie to this site and forum. I just received an 80% rating from BVA but am curious about my other ratings. I received 50% from GAD/SAD, 50% from sleep Apnea, and 10% tinnitus. Additionally I filed for left foot neuropathy, which was cause from a medical treatment from a military physician. Long story short, the podiatrist over treated a planter wart with liquid nitrogen and gave me frostbite on my left foot. The result, in addition to some pretty substantial scarring, was neuropathy. I included in my submission for this pictures, of the frostbite after treatment, medical notes from physicians following treatment, and had a C&P exam that included the traditional statement of "It is as least as likely as not (50/50 probability) that the veteran's neuropathy was related to military service." Yet I was given a 0% rating for this. I am not trying to be greedy by any means but I am just curious if I was rated fairly in this regard. Anybody have any thoughts or suggestions on this. Any help or suggestions are appreciated.
  7. I had two C&P exams today, and one of them was for an increase for my Left ankle. During the examination she measured my scars on my left ankle, left foot toe and my right foot scar. Any idea why?
  8. My claim back in 2014 it was found that my tongue scar was 7822-7800 rated at 10% due to the Characteristic of Disfigurement width measurement. My 2015 reconsideration claim to add a separate code of 7804 for the account that it is also painful was successful, but, they removed the 7800 code for head, face, or neck. The changed it to 7822-7802 so it's still 10% lol....those bastards. So my question is, does it still count as head, face, or neck 7800? It's my understanding that every conflict should be resolved in favor of the higher rating. I mean...it would be a CUE to not see that my tongue is inside my head lol! Thank you!
