  1. Good Afternoon All, I have a PTSD claim for increase tomorrow via video conference. I know that if you went in person, they wouldn't let your spouse or SO in with you. I'm wondering if anyone has had any experience with the video conference exam. My wife is going to be sitting next to me when the conference begins and it will be curious to see if they ask her to leave the room. I saw a video from Attorney Chris Attig that suggested it may be beneficial to an impending appeal (if the claim is denied), if the evidence of the record suggests or shows that the spouse was asked to wait outside and that the lay evidence is extremely important to the claim. At my C&P exam in 2015, they said I had to come alone, but I was granted at 50%. Sgt. Wilky
  2. I've had such great help from so many of you. My husband finally got his 100% P&T for his heart. However, he didn't get it for long because he passed away. Cause of death Congestive heart failure So from what I have read, I should get DIC. I have the app completed, but do not as yet, have his death certificate so when I get it I will apply. I'm just wondering how long it takes to get approved (or denied) once you applty? Thanks so much.
  3. Two of my kids are already using Chapter 35 for college, so I know that I lost the extra disability compensation for the kids out of my disability payments. My question is if my wife uses the Chapter 35 for college, does that mean my disability payment will decrease as well? If so, how much?

    Help with DIC claim

    Hello all, I am a widow and I am trying to file a DIC claim, but I need help. My husband died March 21, 2020 from liver failure (primary) and chronic cirrhosis (secondary). There was not an autopsy. He was an OIF veteran, and was rated 100% due to PTSD and major depression on August 12, 2013. His rating was made permanent and total in December 1, 2019, so I know I don't qualify based on the 10 year requirement. However, I believe his death from alcohol is directly related to his PTSD and major depression. I had conversations with him while he was still alive where he admitted as much. He was seeing a counselor to help with his depression, I have some notes from her, where she notated that he was drinking less that week. I called her to see if she could provide a statement to help, but she had to call her malpractice insurance company first, and I have not heard back. I have initiated the claims process with the VA, and am currently working on form 21-4138 Statement in Support of Claim. I have family and friends who can make statements supporting my claim that he drank to self-medicate for his PTSD. Any tips or advice you can give me to help fill this form out without screwing myself over would be appreciated! Thanks, Erin
  5. I am the sole caretaker for my spouse which makes it extremely difficult to leave and go to a VA facility to file my claim. When I registered for Ebenefits it says I have to have a Premium Account but I cannot just leave for the in person verification. It is imperative that I get benefits because of recent health status and also the full time care my wife will need if/when I need a treatment plan. Can somebody direct me on how to get VA Form 21-526 filled out and also to obtain my C File? I have a portion of my medical record frm my time in service in the Army from 1972-1976. Any help or guidance is greatly appreciated, I live in a fairly remote area without a local VSO or Rep. Regards
  6. My father, Veteran, and mother have had A & A of $2120/ month for their joint assisted living. Dad has Alzheimer's and will be moving over to skilled nursing on Saturday. He is on hospice with Alzheimer's. We have to apply in April for Medicaid. Mom has essential tremor and stints in legs. She can't live on her own and will remain in assisted living. They reside in Indiana. I've been told by VA over a phone that mom will not receive ANY money. Then on another forum an assisting veteran tells me to send in a form 21-4138 and mom will receive the entire benefit of $2120. No directions on this form. Or will dad only get $90 and no income for mom? She only has $600 Soc. Security. Oh, please help. I am their fiduciary and daughter.
  7. Hello Fellow veterans, It's been such a long time since I posted here. I come to you with a question. I sent in a claim for A&A for my spouse. I received a letter today that states: Your current benefit payment will continue unchanged. What We Decided Aid & Attendance for Spouse - Effective Sept. 18, 2014 ~ Entitlement to additional benefits based on the need for aid & attendance is established. ~ Entitlement to aid and attendance allowance for "My Spouse Name" is established effective Sept. 18, 2014 - the date you filed your claim. So, I'm confused, will I receive additional monetary benefits or not and is there any additional benefits for a spouse that has been approved for aid and attendance? Thank you, Cherie33
  8. A VERY close family friend passed away suddenly a couple weeks ago, and he was married three time, the third wife he was married to 31 years. Apparently he didn't change his insurance beneficiary information so his first wife and son got the insurance, but the VA sent a letter to his current wife/widow stating they are denying her anything even though he was 100% P&T S/C. I am digging into the CFRs and USSCs, but any insight into this would help speed the process, as I leave in 5 days for home to attend his funeral and pay my respects, and attempt in any way I can to help her get something from the VA has his current spouse of 31 years with dependents with her. thanks!   9. From time to time I see that buddy letters are used to help develop the continuity and nexus of a claim. I also see recommendations for letters from a spouse, children or other family members. Does the VA really consider this strong probationer lay evidence? I hadn't thought about having my wife write a letter, but if it will put another nail in the claim, maybe I should. Any thoughts or past experiences? Happy Labor Day! Mark
  10. Hello, I am the spouse of a disabled veteran. He has served honorably for 30 yrs, he has been granted 100% disability with Housebound. I have a hunch he is not receiving all he is entitled to and am here to do research to see if i am right. I am trying to understand the SMC and all I keep finding are the letters, L, M, N, O, P, Q, R... S... I can't find the definitions. If someone could please direct me to where I can find those definitions I would be most appreciative.
