  1. SO I been on ssdi since 2011 or 2012 for ptsd. I am rated 100% p&t for ptsd by the VA. I just had a cdr and they're going to stop my ssdi. The reason they gave is this, 'Medical evidence in file shows that you do have mental health conditions. However, your conditions are not so severe as to meet the requirements for social security disability. We have considered your mental health conditions and have determined that you are still capable of simple work that does not require sustained social interaction. We do not have sufficient vocational information in file to determine if you are able to perform any of your past work. However, based on the evidence in file, we have determined that you can adjust to other work. Questions: 1. I am requesting a reconsideration and that my payments continue, but The letter I just got today, 03-05-2021, is dated 02-26-2021 and SSA office is closed already. So I'll take it on Monday, but it'll be past 10 days... Will they continue my payments? 2. During this cdr I asked my new va ptsd doctor, last one retired, to write me up a letter stating their opinion on my ability to work. She claimed she couldn't or that the VA doesn't allow that anymore. Is there a way I can get an opinion letter from the va? She has told me it is her opinion I can not work at all and that it is reflected in my medical notes. 3. Is there any other steps I need to take before my first hearing?
  2. I was trying to find my SSA records but so far I haven't. There are over 5,000 pages in this version. I have tried several searches, but to no avail. I have searched for the individual whose records where mixed up with mine but so far can't find those either. Since I should have at least been awarded TDIU back to the time SSA found me unable to work, based solely on service connected conditions, this is important to my claim. There are lots of new military records. Lots of names blacked out. I guess the VA doesn't want us looking up any of them.
  3. Got my HLR call Saturday. Yes, Saturday. Hard to believe that someone in the VA is working on Saturday. Good thing the phone displayed VA or I wouldn't have bothered to answer it. I submitted my HLR back on 2 June 2020. Her call was on 24 October 2020. 144 days. The VA will definitely not make their goal of 125 days to the decision on this one. I am not sure what she had looked at in my case, if anything. She wanted to know what I was disagreeing with. I explained to her about the CUE I had filed, all the trouble I had getting VA to accept it. I explained to her how the VA had requested C&P exams when all I was trying to do was get the VA to look into a CUE. I explained to her how since the VA had done C&P exams the rater had put in the effort to communicate with the examiner twice to reduce a rating from 40% to 20%, yet the examiner couldn't find my SSA grant. I explained to her about the SSA records in my C-file, how I had about 20 pages of someone else's records in the middle of my records. I told her maybe this is part of why someone didn't approve it sooner. I told her it looked to me like someone dropped the paper files and didn't have enough sense to separate the two files. I told her about the latest denial where the rater looked into the SSA records and found a denial but didn't look up the grant of benefits that is in the SSA records. I explained to her that I hadn't worked since June 2000. I told her about the VR&E denial based on my doctors statements. I told her how the raters kept denying me stating other evidence in my records showed I wasn't unemployable. I explained to her how the raters kept saying I quit my job, but M21-1 says that doesn't have any affect on the decision. She seemed very sympathetic. She said she would take care of me. Well, it will be very interesting to see if she does. I had a prior call from a lady at the Roanoke VA, she thought I was going to get approved. In just a few weeks I got the denial. I had written to my congressman about all this crap. I got a reply back from the congressman's office but it was the same BS from the VA. I sent back to the congressman's office quite a few pages of all the documentation showing the VA crap. I think this was sent by the congressman to the VA Secretary Wilkie. I have no idea if this is at all related to the call or not.
  4. Has anyone seen this in their E-Benefits status? Pension - to SSA for med evid used in disab dec If you have does it impact my UI claim if I have never filed for SSA? Currently at 80% hoping to move to 100% with UI.
  5. Curious I called my local congressman whole said they were putting in an inquiry due to being Permanent and Total and to they would see if they could help. This seems fairly quickly moving as fair as SSA is concerned so I'm told, is this due to someone submitting in an inquiry for me?
  6. During my intial claim it took 4 months I was told it was expedited since I was a veteran. Apparently that was different then I'm now being expedited in my appeal for being Permanent and Total. I provided the decision that has the notification that lists all the medical evidence used to make this decision and I was wondering if anyone has a similar experience. In Delaware I have to go the reconsideration appeal first which began on May 5. June 22 is when I handed the decision for P and T which was back dated to Nov. 11 the date which is on my SSA claim as when my SSDI should be started. I know my chances are low at this Appeal level like 10.5 percent of going my way but showing that I'm now P and T could raise those chances maybe? Does anyone know how quickly it really speeds it up? It's been with the DDS since May 12.
  7. In 2012 I was awarded 100% on mental alone and given all the privileges that go along with 100 percent. SO they have me at 100% mental and 60 % everything else. they set aside issues such as my ankles and lower back as well as my claim for employability and as well as other things. Now I have found a new case popping up and it is called freedom of information act and they have called my SSI file is it possible they are aiming to remove my 100 percent after only 4 months?
