mobie16r
BETRAYED, I am not Vike, but a form 9 wiil be attached to SOC and this is what you fill-out and return to your regional office where your initial claim is,if you disagree with the decision that was made on your claim at your regional office, it will be forward to board of veterans appeal (BVA)in Washington DC for decision, and it still is a NOD.Ihope this will help, but i am sure someone else will come along shortly and explain better. mobie

Now I am told because there were no SOC's issued those form 9's I submitted are looked at as NODs? 5/31/2006 Form 9 Submitted by Oakland Cty VSO to DAV for forwarding to DVA. 1/22/2007 Form 9 Submitted by claimant to Appeals team with copy to DAV requesting forwarding to DVA, and copy to Oakland Cty VSO 3/6/2007 Form 9 Submitted by claimant to Appeals team, also submitted to DVA via Oakland Cty VSO. Copy to DAV.

Now I am told because there were no SOC's issued those form 9's I submitted are looked at as NODs" Yes, that is correct. Remember, the Form 9 is to "perfect" an appeal. The first step in the appeals process is to submit a Notice of Disagreement within one year of the rating decision in question. HadIt.com Elder Pete53 Posted May 9, 2007 HadIt.com Elder Share Posted May 9, 2007 Remember that you claim is not continued on without the form 9. You have to file a Form 9 or your claim can be bounced. Has to be filed on time also.

Vike 17 I submitted NODs no action, requested reviews and hearings no action, no SOC's, one year mark approached and I submitted form 9's. I would think that I am safe now, as I submitted everything I was supposed to. But now I am under another deadline?
