Question

I opened my c-file regarding C&P for depression and I just re'd a call from RO

aand they are scheduling me an appointment for hearing and tinnitus. I have had 10% for bilateral tinnutis and 0% for hearing since '85 so I've met the 20 year rule so i don't understand why? I did have a hearing exam the other day totally unrelated at the VA and they said I have to wear hearing aids in both ears but my hearing isn't real bad in 500, 1000, 2000,etc frequencies. High frequentcy is up to 55-70 db loss. I don't know why they want me to be evaluated, I can't believe they are wanting to help....

Does this mean you filed a claim for depression. How long ago did you file the claim?

When a vet files a claim, the VARO request the veterans medical records. It is very possible that the VARO got your records and noticed the very recent exam. Since you were already SC'd for hearing and tinnitus and your condition has worsened they very well may have decided to re-evaluate your disability to see if it warranted a higher rating.

Just my opinion, but I think there are some at the VA who are suppose to take the file and evaluate the "file" and make recommendations for the veteran. Remember they are supposed to assist the veteran in this. I think those who file claims that are less complex may benefit from the duty to assist where those with more complicated claims are lucky the file doesn't just get shelved.LOL

Are you sure they are looking at both your hearing loss and tinnitus or just the hearing loss? The VA does not routinely solicit claims unless they see that there is entitlement to additional benefits while reviewing a claim. Since you are already receiving 10 percent for tinnitus, this just doesn't make sense. Another thing is that they could just use your recent audio examination results, if it contained the required decibel losses and speech discrimination without needing to do another examination. I'd call your representative and ask them to review their copy of the VARO's examination request to determine exactly why they are reevaluating these conditions.
