Berta Posted May 24, 2007 Share Posted May 24, 2007 (edited) will prepare that and attach in Word for you TBird- I had another thought- in a few weeks I will be guest speaker on SVR radio -and maybe what I prepare for that show could be added to the hadit content- I am thinking of something I mentioned last night-on the show- the land mines that can befall a claimant- meaning-depending on treatises or studies or other BVA claims as evidence- yet the VA will say-if they even read it- that the information is not specific to the veteran's own disability- or getting a lousy C & P and how to challenge the actual C & P report-if it is deficient- Mike Harris was on the air too- and mentioned challenging a bad C & P prior to the VA's consideration of it- I need to ask him more as to exactly what he meant by that--- A big landmine I see is if a vet fails to adequately address everything in the VCAA letter or the SOC with a good rebuttal. And with the internet easily accessible in public libraries -even without a PC, a vet can take the time to try to obtain buddy statements or at least enough knowledge of 38 CFR to help them challenge a denial. The Schedule of ratings-which I believe VA still sends the corresponding section of with any SOC it involves-clearly states what evidence can warrant specific ratings and the veteran can try to shape their evidence in order to fully comply with the schedule- Unfortunately these days the only way to surely combat a negative C & P is with an IMO.And chances are if the C & P came from a PA or a nurse, an MD IMO can potentially overcome it. It is so unfair to have the VA state that the veteran or widow is not competent enough to render a medical opinion and then have the claim denied on the basis of a brief C & P. When I talk my speeches in the V.A. waiting rooms during my appointments, some people listen and others act like they do not want to hear me. We are not going to mention the looks from the staff. I keep telling my wife that I would love to hold coty meetings on this issue. I have tried to contact the newspaper and T.V. stationes about the V.A.issues with no luck. I have not tried the radio at all. I do not know if I would be allowed to talk with all of the FCC language censorship. It will be very hard to stop my cussing when I get pissed off about the V.A. BULL$HIT. I am sure that I could handle myself accordingly. I will just need to try to have my mother help me with my words.
