Question On Missing Doctors Report

Question

My Husbands C&P Exam is next Tuesday. There is a good chance we will not have medical reports from two of his doctors. Keeping our fingers crossed that we will have them the end of next week.

Should my husband tell the examiner that his claim is not complete??? Or do you usually have some time before it goes to the raters.

Hi Justme1949,

Are the medical records that you are speaking of his private doctors records or are they medical records from doctors at your Veterans' Medical Center?

When your husband applied for service connection benefits, did he give the VA copies of his private medical records?

Are these medical records just more recent ones since his filing date?

Do you have a copy of his C- file with his Service Medical Records and his Personnel Records?

The medical records that we are waiting for are the most recent ones from his private doctors.

When my husband put in his claim last year his SO had him sign a consent form for his service medical and personal records. We are assuming his records where sent to whoever has his claim. A few weeks ago we also requested his records from St.Louis and are still waiting. His SO has really been no help to us,and it was only after finding this site did we realize all we needed to do.

Don't count on the VA to go after any medical records for you.

If you are looking at a shrinking time limit on sending in evidence, make sure you know ahead of time how to ask for an extension of the time limit.

Get them, your medical records, yourself and then send the VA 'COPIES' of those records.

If you are expecting the C&P examiner to read your records before the exam, the examiner normally will not but, will say that he has reviewed all of the available, pertinent medical records. If he is using them for a doorstop they were not available. If something falls out of the folder and the housekeeping folks use it for toilet paper, it's not on file.

Get a copy of the examination report after the C&P examination. That'll help you understand where you stand with the VA.

That request might take a little time. Be real nice to the records folks at the VA, it helps.

After you get the report, compare the findings of the C&P examiner to the official VA examination protocols to see if everything is kosher. Whatever you need can be found here, just ask.

If something looks bogus, get an immediate second opinion from the private sector so you can rebut the politically motivated, career minded, retirement protecting, stupid findings of the lame VA examiner.

Your health, standard of living and quality of life are not his problem and he probably hates his job.

If, by some quirk of fate, the examination is what it's supposed to be, you are really fortunate.

Keep your copy of that C&P examination in a safe place because you will be needing it later.

When the Regional Office gets around to 'selecting' which pieces of evidence to use in your case, the good stuff that backs up your claim 'may' not be in that pile.

The folks that decide what to use as evidence to decide your claim might come up short and need to 'modify' a record or 2 in order to deny the claim. They can also lose, ignore and discount anything in the file that goes against their game plan to impress the boss with saving the government's interests from being squandered on a non-voting, lazy, low-life that is trying to fraudulently pick the treasuries pocket.

Keep your records safe, handy and in order.

The Regional Office (RO) will be sending you something, sooner or later, that is very confusing or just doesn't make any sense.

This whole process is so complicated and discouraging. I sometimes wish my husband just continued his PTSD counselling and never put in a claim.

If not- believe me- they often do not obtain what they say they will-your husband should request them himself.

Is he employed? If not does he receive SSA for the same disability he wants VA to SC?

If he is not employed and a private doctor said his PTSD is of such an extent that it prohibits employment he should file for TDIU also.

I hear your frustration-

But DONT give up.
