Question

On Monday I sent the following via IRIS:

I would like to check the stauts of claims that I have pending. I had applied for increased compensation for my back, right knee, left knee, and ankle in Oct 2006. Filed new claim for depression in Oct 2006, and filed for Sleep apnea with use of CPAP in February.

Thank you for your assistance.

Today I received this as an answer

As of to date, the following information is submitted in reply to your request concerning the status of your “pending claim”.

1. Increased Compensation Claim- Your claim for increased for the conditions as listed by you in this Iris Inquiry was sent to the Ratings Board for a decision on June 06, 2007. We anticipate that the Ratings Board will reach it’s decision in about thirty to forty five days.

2. Please note, it is our desire to process all of your claim actions as quickly as possible.

I had my sleep studies conducted by a privater pulmonologist. The C&P for depression was done on the same day as the C&P for increases.

Anybody have any opinions on this?

Thanks Pete,

I sent in a reply to their reply asking about the depression and sleep apnea claims since the reply stated "Your claim for increased for the conditions as listed by you in this Iris Inquiry was sent to the Ratings Board for a decision on June 06, 2007." It makes me wonder is the other two claims are going to be deferred.

I got a response to my second IRIS inquiry:

Your claim which was submitted to us on October 20, 2006, for the conditions as listed in this Iris Inquiry was submitted to the Rating Board for a decision. The Ratings Board has made a decision on you claim. You should get a letter in thirty to forty five days announcing what the Ratings Board decided

From what they have told me, the claim went to the rating board on June 6th, right after I sent an IRIS inquiry and has now been rated in eight days. I hope that means that it is good news and not that I angered them so much that they deny the claims

If you have a POA he might be able to tell you if your claims were granted. Usually, someone knows if you won your claim but they don't want to tell you until you get it in writing. I just keep calling and asking and I have always found out from someone eventually.

huskerfanfl,

I'm pretty sure when the VA said "Your claim for increased for the conditions as listed by you in this Iris Inquiry" probabaly included the sleep apnea and depression. Normally, the VA will send all of the claims to the rating activity to be decided all at once. Probably the only time they would not do so is if one or more claims could be granted while maybe others need further development. I remember reading just recently somewhere that VA policy is to not withhold a grant on claim(s) while development is needed on other claim(s).

Thank you for the responses. I received a C&P for the depression/anxiety in March, but have yet to receive one for the sleep apnea. I did send in copies of my medical records to include the two sleep studies and the need for a CPAP.

I emailed my AMVETS rep to ask if he had heard anything or could find out anything. The waiting is the hard part of this whole process.
