Hello

I was just awarded P&T status. How many people here have been approved for SSDI just based on being 100% P&T? Anything I can do to improve my chances of getting approved based on the P&T status?

Thanks for all the help and input.

I went today to see a DDS doctor. They did a very through interview for over an hour. They drew blood, did chest xrays, pulmonary testing and went over all my medications and side effects. The doctor wrote down everything that I said was an issue with me. She said that it will take around 4 to 6 weeks for to get an answer. It did seem like she was trying to help me and was even Sympathic about my health and family situation. So should I take this as a positive sign? Also the case worker at DDS said that she setup the appointment to try to help my case. She felt that they did not have enough current info and my case most likely would have got denied.

If you have enough credits it automatic. You got the hard part out of the way. Just a matter of paper work you'll know in 6 wks.RC

Hello all

I just wanted to update you all. I got denied for SSDI!! After all the crap I went through. I was able to make it back to work for 4 months, but I'm getting ready to get fired. My CD4 count is now under 200 and I'm on 4 different Depression medications. Yet I'm still too dam healthy for SSDI. The only reason I'm still at work is because my boss is a friend and knows all the crap I'm dealing with. Anyhow anyone knows a good Disability laywer in Miami?

Your not going to get SSDI if you are working. Thats the bottom line. That is the first question on the application. Are you currently working?

The only way you can make it stick is to try to work with an unsuccessful outcome or to have worked out of desperation but 4 months is probably too long of a time period.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

I understand that I'm not going to get SSDI since I'm working. That was not my question. I can no longer work. I tried and failed. I'm in the process of getting short term again. I'm starting all over again. This time my condition got worse due to work related stress. I just can not work. My doctor said I must stop. Even Voc Rehab turned me down saying I'm not qualified because of my health. So my question is who knows of a good SSDI Lawyer in Miami, FL?

With the information you juat posted you probably do not need a Lawyer. Just file your claim with SSD and look for a Lawyer if you feel that you are not up to dealing with Social Security.

Good Luck

There have been several Hadit Members who got quick approval after stopping work on Doctors Orders.

Veterans deserve real choice for their health care.

I understand your frustration.

It would be wise for you to look at the Social Security blue book listing level of impairments (Adult).

Check your ailments and compare them to the list. If you find one that mirrors the listing level impairment criteria, Then you should be able to win.

If you have wait to see the ALJ, It could be as long as 3 years. 2 years in my state and I am sure since Florida is the retirement capotol in the US they are probably backed up.

Anyway, try this link out.

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”
