Moved My Cfile To Jackson Miss Varo

I have been waiting patiently since Feb for my claims for PN, IBD, Hypertension and several more with Chemical contamination , supporting test and doctors nexis including possible nuclear exposure from the entombed reactor at Fort Greely. Below is some of the letter I got in my stocking today.This letter is from the VARO in Houston informing me of their transferring my entire Cfile to Jackson Mississppi and they said it will take many many months now.

Dear me,

We are writing in connection with the claim that you filed Feb 2007,however we need to notify you of our action. The Dept of Veterans Affairs is centralizing the processing of all benefits claims related to a veterans exposure to radiation while in the military service to the VA regional Office in Jackson , Miss. This is being done in order to provide better service to this special category of claimants.

Because you have filed a claim based on radiation exposure , your calims folder as been transferred to tthe Jackson Regional Office. Following completion to the radiation claim your folder will be returned to the previous office. If you have other claims pending in addition to your radiation claim , the Jackson Regional Office will also handle those claims.

HOW YOU CAN HELP

You may also submit statements from the individuals having knowledge of your claijmed condition. THese individuals should tell us what they observed of your condition, including the approximate dates, places, and circumstances. They should clearly state whether they actually witnessed the event leading to your condition. If they were in service with you, they should include name, rank, and unit of assignment. All statements must have the following certification: I hereby certify that this information is true and correct to the best of my knowledge and belief.

It thens list the address and below in the last paragraph....Because of the research required to determine a veterans level of exposure to radiation while in service, these types of claims often take MANY MONTHS to process. Please be assured we are doing all we can to resolve your claim as quickly as possible. We appreciate your continued patience............

Oh yes they are still going to send a copy to the recently fired DAV , as I have changed POA with another VSO and they have acknowledged that on the phone but not in this letter. I also am getting ready to file 2-3 more claims in the next 30 days.

HAS anyone else had to deal with this radiation exposure >???? I have a letter from IMO telling of the link of my IBD and exposure to radiation as the cause. By the Army's own messup the reactor dumped waste into the creek, and then into the ground water and finally the reactor got away from them the year I left and they had to entomb it in 1973 and can not touch the casing until 2030 AD. Ok , so what do I do ???FIle the new claims for COPD, Arteroscherosis, and Dry Eyes, which I just have the new test results and diagnosis. Provisional COPD ruling has me at 30 percent from the schedular. I am also considered a FTCA law suit so does anyone know of a good lawyer that wants my case.

Bill- I am surprised that they are refering your claim to a different VARO- I know it might take longer but perhaps they can focus on this type of claim better at this other RO.

I would think with the right evidence any RO could handle this but then again-it looks like they are centralizing these types of claims- and I wonder why---

I dont see the basis for FTCA here but if you Google FTCA, the info will come up on the internet as to what these claims involve.

Well, this blows, for sure! But, as Berta said, maybe once they have the program streamlined at the new RO, it will streamline the process for vets with your particular problem. I would advise against filing another claim until you have this one resolved. It will only serve to further gum up the works, as they will want to marry the two together. Maybe you could file an informal claim on these and file the actual claim when the first one is resolved. Good Luck!

Thank you Berta and Rental Guy, The move to another VARO in Jackson sounds like a stall, as I have claims for PN, Hypertension, Blurry Watery eyes, Inflammatory bowel disease,loss of motor function all pending.Now have the others COPD,Dry Eyes,Artherosclorsis which have been diagnosed just a couple weeks ago. The other claims I believe should be filed just because they are so strong on my other claims as part of the chemical contaminations. I have all of the documents from the agencies monitoring and try to clean up the mess at Fort Greely. I have 2 great IMOs and 2 more pretty good ones from VA that are good.VOlumes of documents.

COncerning the FTCA suit,,,this is because of failure to treat diseases and symptoms by ignoring the c file and medical reports , documents and nexis thereby causin me to worsen. Even to false causes on my Doctors notes. I at least want to meet with a lawyer....Anyone have a lawyer that would like to listen.

Also I am going to talk to my VSO and probably submit another SSOC 21-4138 to carefully list the stage of events and pertintent information that the Army , ADEC, BRAC and Advisory Board have documented and recommended on the radiation exposure from the now defunct Reactor, that one Doctor has written a great nexis on and another has commented.

There are plenty of malpractice lawyers around-some with VA case experience-

The FTCA has a two year Statute of limits- you must file within 2 years of knowledge of the malpractice.

It takes medical proof of malpractice ( a lawyer will usually want an IMO to support malpractice)

and medical documentation of the results of the malpractice.

Hello Berta,,, Thank you for the lawyer info....Also is there anyone or do you know of any radiation exposure veterans who have succeeded in there claims. This is due to the nuclear reactor and its entombment. Dr. Bash has listed the Inflammatory Bowel disease as being caused to the radiation exposure in his nexis. I really need some direction on any vets claims that have succeeded ....but not concerning a blast. Documents do show that the reactor dumped waste into Jarvis creek. Documents also show that the Army stopped this procedure and then started to steam the waste and putting into the ground and contaminating well water on the post. The site is still monitored by ADEC as unsafe and hazardous to human health. This is not only the pipeline to the creek from the reactor but also the reactor being entombed because of a "problem" that the army will not divulge everything about immediately after I left in 73. I hope all I need to do is supply the SSOC pointing all this out. Merry Christmas. CC

      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
