Question

When I called the 800# on Dec 18th they told me my files were back with the DRO.

When I called today the lady had me on hold for about 1 min and a half, she came back on and said my appeal was in final decision and that I should be hearing something soon.

She said all my medical evidence had been reviewed ( two c&ps and new statement from corpman from Nam) so I hope to get some news soon.

That is a lot to get from an 800 rep.

I have been unable-even via Iris -to get a confirmation that VA has my IMOs and they are being reviewed.

But they said recently that the DRO will make a decision by Dec 30th and it will go then to the raters.

They do say all 5 Volumes of med recs are there.

I just realised something- I have never seen my husband's USMC SMRs- I only got his Navy SMRs from NARA with a letter that the RO had all of his Marine Corps SMR records.

We have one guy at our VARO, a retired 1SG, who will actually research a question for you and provide a fairly detailed and accurate reply. If it is something he can't do while he has you on the phone, he will tell you that he will get back with you on so and so. And he does!!!! Most surprising thing I have ever seen. The first time I dealt with him he told me I asked for an update on my claim and he said that it was still with the rater. I said, good Lord, it has been pending a long time and since it is a fairly easy claim it should have been done a while ago. He said, I agree, let me call you back Mr. Ricky. I will run it down and see if I can find out what the hold up is. I will call you back by the end of the day.

To my surprise he called me about 3:30 that day and said hey, got some good news for you. The rating team had released your file to the post decision guys and forgot to update the computer. That was done on xxxxxxx date (which was about a month ago). It looks like your claim for x was approved and your new percentage will be 80 percent and it looks like you have a check coming your way for x amount. Now you will have to wait and see the final award before we know the exact amount of the check. That is just the amount that has been initially figured.

Hell I fell outa my chair and was speechless for about an hour. My wife screamed cause she thought I had had another stroke hahahahahahaha. I talked with him for about a 20 mins about the reasons for the award and asked him why he had done what he did. He said its my job and I like to do it. I am a retired 1SG and I look at all of you guys as my troops, therefore, I will do my best to assist you in any way possible.

Now every time I call the 1-800 number I hang up until I get him on the line. All of the others just answer the phone and give you the 5 second spill about its still at the xxxx team and you will just have wait cause we are very busy - is that all I can do for you today? I think to myself, yep I guess it is cause that is all you are going to do you idiot. Most of them attempt to intimidate you, make you feel stupid and are just plain out nasty to you.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
