You should call today and find out if the meds went out and how they are being sent. If by Fed Ex, get a tracking number and find out if they were sent overnight. If the meds have not go out or didn't go out overnight, tell the nurse that you want the doc to call you in a script at your local pharmacy for enough pain meds to get you through until what they are sending you comes in the mail. This is unacceptable treatment. There is no excuse for you being out of your meds like this or the fact that they didn't tell you that they would wait for the results of your labs before entering your scripts. Also, ask the nurse what labs they were waiting on and get the name of the labs and the results. After you have that information, you should call the patient advocates office and explain the situation and ask for them to look into how this was not handled properly and that you want to make sure this isn't a trend because you don't deserve to be treated this way and no other Veteran does either. Let us know what you find out and we will go from there.

I get my narcotic meds via certified mail through the USPS. The VA takes their sweet time about sending them. If I ran out Friday I would be sick by Saturday. I keep ahead of this situation. If is difficult to depend on people who have so little regard for our health.

Speaking out is right call and get the tracking number and than look for when it is supposed to be delivered. If not today go to the VAMC ER and tell them to fix you up than and there.

Veterans deserve real choice for their health care.

Thanks guys, I appreciate the support. Still nothing, I've called the VAMC's pharmacy twice today and their still not in. I'm not sure what else I'm going to do.

I contacted my dr.'s nurse, and their "pending", what the *u** is that? This is outrageous! How could a medical personel (nurse and dr.) live with their consionce (not spelled right) treating people like this.

Since your VAMC is this bad I would consider in the future to try and get my pain meds outside the system if you have medicare or other insurance. I am just throwing this out since I don't know your situation. I would hate to depend on the VA for anything crucial like narcotics where I go into withdrawal if I don't get them. I been there before! I would go to the VAMC ER with my empty pain med bottles. If you start to get sick throw up on the admitting room desk clerk.

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”
