Received My C & P Appointment Letter Today..

I sure hope so...I know that it's a constant battle and I am trying to get prepared. They scheduled it for the 30th of April. Wow, I'm nervous already. I really need this.

I'll keep you all updated.

Does anyone have any idea of how long it usually takes to get a decision after you complete a C & P exam? I've got a few more things that I would like to submit as evidence. What should I do? Submit it before I go to see the C & P doc?

Thanks,

Cherie33

finished exams for iu here too, off to raters next, pins and needles with you, praying hard to get whats needed. I'm guessing between 3-6 weeks or so after exam to transcribe docs notes and forward to rater. Also if one selected wait 60 days, that adds time to submit supporting information. Prayers, cg

Submit your new evidence before the C&P, so that the Doctor can also

review this new evidence.

I would also take the new evidence with me to the C&P as sometimes,

time is againt you, and you never know how long will take for the new

evidence to be placed in your claims folder.

Just make sure what ever you hand to the doctor has been date

stamped, so he will know the VA does have a copy of it.

When I went for my first C&P, one of my most important documents,

"My buddy Letter," was not within the file. The first thing the

doctor did was to look for the date stamp and then he used it in his

opinion write up.

Without this " Buddy Letter", I had nothing to collaborate I was

telling the truth.

This is just my opinion from my experience

Always,

Betty

Cherie:

When I did my C&P they had a form that I signed that I checked the box that I was ready to be rated on the evidence they had including the C&P. I recommend that you send anything else you want them to look at and make sure you sign the form. You may have to ask for it that was a year ago.

After I did that I gor a decision in three weeks.

Good Luck

Veterans deserve real choice for their health care.

Betty - Date stamped? How do I get something date stamped? I am a long ways away from the St. Petersburg VA.

Pete - I'm not sure what you mean. Are you saying that after my C 7 P exam, that the VA will send me a letter and ask if I want to submit additional evidence or do I want them to go ahead and rate my claim with what they already have?

The evidence that I have is a questionaire that my Attorney (who is representing me in my Social Security Disability claim) sent to me and asked me to hand deliver to my doctors. I have already received one of them back from my VA Primary Care Dr. and I am waiting to receive the other questionaire from my VA Psychiatrist. I think that I will go ahead and send in the one that I have, and hopefully I will receive the other one soon.

What do you all think?

Cherie,

I had turned in the " Buddy Letter" already to the DRO at the R.O, but was just a little

suspicious, so I carried my copy with me and it was the best thing that I did, for

this one important document was left out of my C-file.

If you have anything that is very important and beneficial to your claim and you

have already turned it in to the R.O , these are the documents you may wish to

take with you. To be on the safe side. This is only my opinion, for it happened to me.

Always,

Betty

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”
