Chap 35 Dependent Health Benefits

If you are 100% P&T is your VA c-file opened again for review at the VARO when you apply for:

1. your spouse's Chap 35 Dependent Health Benefits?

2. the premium waived life insurance?

3. dental care?

After reading how a vet's file is re-opened if they move from their home state I wonder what other actions cause the VA (or give them an excuse) to re-open your VA c-file?

TSS I noticed you didn't get a response on this question. Its a good question in fact, I believe what you are asking is if your compensation file comes under review if you ask for benefits associated with your rating of 100% P&T (oh yeah!good for you!).

I don't see a reason that your rating claim should be bothered at all if you put in for benefits that are inplace for the asking now that you have p&t. Its my understanding that unless there is something medically flagging or a exam review date come up, thats usually when your rated condition is up for checks&balances. At this time I can't recant the regulation on this, but I think you are double checking the double checkers as a protective measure for your hard earned benefits.

Like CG, I think not.

I mean, after all, they just got through spending a lot of time and effort attempting to keep you from drawing the benefits that are rightly yours (some folks may see it differently, but, I calls 'em lak I sees 'em).

So, I think it would be kinda hard for them to justify "opening" your claim again, just because you are "seeking" what has, in essence, already been "awarded" you.

P.S. I certainly have trouble saying things like "awarded" when referring to claims that have been decided in your favor. It makes it sound like you "won" the freakin Lottery! Which is supposed to make you feel "grateful" that you "won" I suppose. B! S!

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.
