Berta if I was given a diagnosis for DDD and other, more severe injuries existed i.e CT scan from 94 (I'm in the DRO Review now) is there any thing else I could do if I should have had a much higher rating when discharged from service? Such as a Que claim or lawsuit?

Yoggie- we must have ESP- I have been thinking both CUE and malpractice might have occured in your situation.

Do you have the 1994 decision?

yes the Medical Eval Board but to me the CT scan and MEB don't jive?

I meant the 1994 VA decision on your claim- when they first rated the DDD-and gave is a % and diagnostic code--- that is where the CUE would be- if there is one-

And if the VA had evidence at that time that supported a higher rating.

Jesus, I wouldn't even know where or what to look for it is it on the MEB from service, like a Number code? Berta I don't remember what or when just they raised it from 20 to 40% and it was for DDD period

This is what I found and cut and pasted it Army gave me 20% after the VA reviewed my file they raised it to 40% in a month? I was shocked at that time cause I figured I be put out with nothing because not being able to finish my third tour I'd be kicked out and this is the way they made you feel so I felt at the time very fortunate, and I never knew the existent of my injuries. But now I know if the VA doubles any thing, I suspect foul play. Below is a excerpt of my MEB of what I think they used? along with a permanent profile. and called it DDD syndrome.....

DUTY RESTRICTIONS! Ho crawling, Jumping, marching, running or prolonged sitting or standing over 2(2) minutes, no lifting 35 Ib, no rucksack, no sit-upe on the PT teat.

RECOHMENDATIQNSi Refer to MEB/PEB for disposition IAW paragraph 3-39c, AR 421-501.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.
