C&p Exam For Iu

So, a C&P Exam for IU looks at ones SC conditions.("The purpose of the C&P exam is to provide very specific information in order to ensure a proper evaluation of the claimed disability rather than to provide medical treatment. A treatment examination is written for clinicians to understand, but a compensation and pension examination is written for RVSRs, lawyers, and judges to understand.")

So I should be thinking evidence? They have already ruled that I have SC conditions. The nature of the conditions says they will not improve.SSD has declared me disabled. A letter from Pvt Doctor "can not work because of DM2 & PN".Have not worked in 14 months. All of this is already documented and recorded by VA. I have no new evidence.Perhaps they want to see "What condition my condition is in!" <ahttp://www.hadit.com/forums/uploads/emoticons/default_angry.png' alt=''>

lets hope dr.s evaluate each s/c you have, and a rating specialist (?) fairly determines how these conditions interfere with you gaining, keeping employment. the issue can get complex - especially if you're rated on a combined schedule of ratings.. do you have a rep? evidence is the key word for sure. use the search engine on this site.... they got a lot of info..... :(

Be sure that you notify the VA that you are on SSD its important.

Good Luck if you look around you will find some good tips on what a C&P is all about.

Yes indeed, there is a lot of information on here! I was at 40% sc and now

I am 80% combined, dm2 with pn, 40% per leg pn and 10% each arm.

Only 10% PTSD. PTSD c&P was before I started reading this forum!

The ptsd doc, by what he put in the record, he contrived to lowball me. Put things in there that I did not say. my visits go like this, GAF 65, 55, 45,45, 45. I would say that the c&P exam went well in my favor, medical & mental. I hope the rater agrees!

But since this was a C&P for IU, I wonder if the rater could consider increasing my 10% for PTSD? Or can only rate for the IU. :(

And before I forget again, Thanks to all for the help.

If they decide to award 100% they may adjust the PTSD. As you probably know by now a 45 GAF would warrant at least 70% for PTSD.

You should win just be ready to fight if you need to and good luck.

I would say that my C&P exam of the PTSD matched the GAF score of 45. I know that GAF score is not all I need, but the exam interview matched a 45 Gaf. ( Me thinks)

Yes, I have been thinking about my next move, plan B. I have good evidence and it does look good that I will be Awarded IU. But from reading this forum, I know I need a plan B! :(

I will do my homework here and get my ducks in a row on NODs etc. I think the raters probably like it when they get a case that is presented strait forward, pithy and to the point.

I did that on my SSD claim. Made it as easy as I could for them to make a judgement on my claim. 7 weeks aproved. May be the worlds record.

This is a fantastic forum. :D

Got a copy of C&P exam for IU. Which means my exam is now at the raters. The nurse practitioner put in the phrase "is as likely as not" concerning my PN and not being able to work.I am disabled by SSD.Have not worked in over a year.Already rated at 80% with two at 40%.Now I have the VA saying "my unemployability is as likely as not" caused by my SC PN which is from DM2 and Agent Orange. B) PTSD was barley mentioned and I know I could bump that up alot. Plan B. So me and Tom Petty are on hold with the hardest part. It's a pity I quit drinking! It looks good and it's close. I will be one sad puppy if it is negative on the IU! I have been very lucky so far. Thanks to the help on the forum. <_<

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”
