Declaration Of Status Of Dependents

Hello all hope all is well.I have to ask this question if someone would please assist or answer I would truly appreciate it.I recieved my rating and decision from last Sept 2007 for TDIU,increase for service connected conditions.Included with this decision are numerous forms VA Form 21-8764,VA Form 21-686c,VA Form 28-1900,VA Form 28-8890,and VA Form 4107 . I do understand what they are for. My question is this pertaining to Form 686c Declaration of Status of Dependents I have been informed that this is an annual or yearly document that disabled veterans fill out and send to VARO. Is this the case? I have furnished this information to both VARO and BVA as well VAMC in the past maybe three times through out 28 years as to the status of my family so i am a little confused .Thank you all God Bless.

Mac, if they send it to you each year then you just fill it out and send it back.

I never filled one out that I can remember, but, my short-term memory is shot, so I may have.

I filed my claim over the internet, VONAPPS I think that it is called, and in the on-line app it asks for all your dependent information, etc.

I do know that when I got booted up to 80% from 20% that they sent me a form TELLING me that they had included my dependent in my new $.

"It is cold and we have no blankets.

The little children are freezing to death.

My people, some of them, have run away to the hills, and have no blankets, no food; no one knows where they are-perhaps freezing to death.

I want to have time to look for my children and see how many of them I can find.

Maybe I shall find them among the dead.

If you are TDIU you will be getting a letter from the VA every year asking if you are working and asking if you dependent status has changed. I think you will get this letter until you are 70 years old. If you don't get the letter about your working status download the form and send it to them. The VA has a bad habit of sending people letters telling their compensation is being reduced due to not sending in this form even when the VA never sent the form to the vet to be filled out in the first place.

Thank you Larryj and John999 for your replies I am going to fill them out I just wasn't clear or sure if the information has been sent other than everyone being a year older and so forth. I thought once the information was in place no need unless changes came into play.Great thank you

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”
