Life Insurance For Vets At Less Than 100% (not)

Someone said that a vet was elgible and had 2 years window to apply for life insurance after being granted a % for an for an SC condition. It seems that only applies if the vet is in good health and hasn't been denied on any other chronic illness, that you can get life insurance.

Is that correct? Letter of denial below.

DEPARTMENT OF VETERANS AFFAIRS

Regional Office and Insurance Center Wissahickon Avenue and Manheim Street

P. O. Box 7208 Philadelphia PA 19101

Dear ____________ We are sorry we are unable to approve your application for Service Disabled Veterans Insurance (RH).

Your application shows that you have _________________. You indicated that you stopped working on _________, the date entitlement to Social Security disability benefits began due to ______________- Based on sound underwriting principles and experience, this non-service connected condition is not consistent with our requirements of good health for insurance purposes.

The insurance applied for requires that good health requirements must be met in all respects except for conditions which are rated as service connected. The Regional Office did not grant service connection for the above condition.

When we use the term "good health", we mean free from disease, injury, abnormality, infirmity, or residuals of disease or injury to a degree that would tend to weaken or impair the normal functions of the mind or body or shorten life.

The enclosed form advises you of your procedural and appeal rights in connection with this decision.

Determinations as to what conditions are considered service connected are the responsibility of the Rating Board of the Regional Office nearest to you. Any questions regarding these ratings should be addressed to the Veterans Service Center Manager___________________________________________________________________

If you need to contact us, see below. If you write us, please include your daytime phone number. Sincerely yours,

Yes-this type of insurance is available for vets with a service connected condition.S-DVI

Also any vet with SGLI should convert to either VGLI or a private insure if they get a conversion letter.

I believe that veterans who leave service with 100% disabilities service connected have the two year window to apply for it- but not sure-they are definitley eligible for it

http://www.insurance.va.gov/miscellaneous/index.htm

SDVI is different:

"To be eligible for basic Service-Disabled Veterans Insurance (S-DVI), a veteran must have been released from active duty under other than dishonorable conditions on or after April 25, 1951. He/she must have received a rating for a service-connected disability and must be in good health except for any service-connected conditions. Application must be made within two years of the granting of service-connection for a disability. "

They defer the SC disabilities- in other words- if a vet is 100% PTSD and no other major medical problems-this vet should be able to get S-DVI.

"You have two years from the date you are notified that you have a NEW service-connected disability. You do not get an additional eligibility period if you are granted an increase in your current disability. Once you have a policy and are notified of your entitlement to waiver of premiums because of total disability, you have one year to apply for the supplemental $20,000 in coverage"

There is a lot of info at the VA web sute and I believe that even a "0" SC rating qualifies a vet for S-DVI-not sure on that-

Sameo to us -They (VA) have 38 CFR ,38 USC, and M21-1- but so do we.

Thanks Bertha, that's what I thought. I got denied because I have a serious life threatening non SC'd condition, even though I am 30% SC'd and applied within the first year of the SC granted.. Thanks again.

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”
