I am trying to find the regulations that apply to eyeglasses.

My VA eye dr prescribed two pairs of glasses, one for distance and one for reading, and I received a denial letter from Prosthetics, and I'm just wondering what the regulations said so maybe I could fight it.

I'm also looking for the regulations that talk about emergency care, if you happen to know where that is.

You are eligible for hearing aids and eyeglasses if you

receive increased pension for regular aid and attendance or being permanently housebound, or

receive compensation for a service-connected disability, or

are a former prisoner of war, or

received a Purple Heart medal

Otherwise, hearing aids and eyeglasses will be provided only in special circumstances, and not for normally occurring hearing or vision loss.

At 50 percent you are entitled ot eyeglasses.

Call your patient rep and complain. They can cut the red tape. If you are entitled to a benefit and it was prescribed by a VA doc then they should fill the script.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

I received one pair, it is the second pair that they are denying.

It says "we were unable to determine that you are eligible for a second pair of glasses. There is no medical indication for such per Dr Vaghei's note".

So what does he need to say? That's my question.

1 pair for distance and 1 pair for reading = Total combined of 1 pair of bifocals.

If for some reason you told the doc you didn't want a bifocal, then that's why the script

was written as you have posted. In order for VA to fill the script as 2 pair then the

doc will have to put a medical reason that you can not wear bifocals.

I am a Licensed Dispensing Optician and feel sure this is the reason for being turned

down for 2 pair as there is no other logical explanation.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.
