Question

I have claims pending for chronic right elbow tendonitis (cannot lift even 20 lbs and I am right handed), nocturia, chronic pain syndrome, and hypersomnia secondary to nocturia, chronic pain, and allergic rhinitis (which is rated at 0%) I was turned down for sleep apnea but figured I would try it this way. All of these were sent in months ago so yesterday I sent an IRIS inquiry regarding the claims since I have not been scheduled for a C&P and received the following:

"We received your claims back on Jamuary 8, 2008 for the disabilities claims you submited. Your file is with the Rating Board Review team as of June 17, 2008. This the team that reviews the evidence and forwards it to the Rating Board for a final decision. You will probably have a decision on your claims between now and September. You will hear from us in writing when a decision is made.

Anyone have any ideas? I do have support for all of this in my medical records. I have had nocturia since before I got off active duty, the tendonitis is addressed both on active duty and since, the VA is treating me for chronic pain, and have the reports from the pulmonologist concerning the hypersomnia.

I think this is the same as the pre-determination team. They look over the claims and all of the evidence in your c-file, then gather any new records from any federal agencies and schedule you for any C&P's. Then your claims will go to the rating board. If you really want to be proactive, get in touch with the C&P department at your local VAMC and ask them if your name is on their radar screen to be scheduled for a exam. Then, politely, ask then if they could investigate as to whether or not you will be scheduled for any exams. Having a contact in that department at the VAMC can be priceless.

It has been my experience with Louisville RO. The same one you are dealing with, likes to use a C @ P exam later inthe process.

He would have told you or gave you a hint about a an exam or medical opinion needed.

You can call the Louisville VA and ask for the C @ P department. Unless one has been requested for you then they will have no information.
