Any Chance To Reopen My Ssdi Claim?

I received my 100% VA disability for unemployability 8-9 years ago. The rating was based on combat related injuries from VietNam. I shortly thereafter applied for SSDI. During the original hearing, the court appointed occupational specialist testified that considering my disabilities, I was unable to work. The judge disagreed, stating that I could operate a carnival ride or work as a mailboy in a large office. Honest! (I live in the country.) He turned me down. My second appeal was denied, which my lawyer claimed was automatic. During the process of my third appeal, my case was transfered to a SS office several hunderd miles away, and my lawyer declined to travel, and dropped the case. For reasons that I do not understand, I was again denied. The denial was not based on my disability, but had to do with the paperwork. After more than three years in the process, I basically said the heck with it. At this point in time my health has taken a downturn, and my wife may lose her job of long standing because of the economy. I'm several years away from being able to draw regular SS. Social Security says I'm no longer eligible to file for SSDI because of the length of time since I paid any SS. Is there any way that I reopen or appeal the findings of my claim. Would any my elected officials be able to help? Any info is greatly appreciated.

They do have that criteria- BUT- if you were 100% disabled all that time- how could you work and pay into SSA?

I dont know if you can re apply -but I advise you to contact Allsup,Inc-

they are SSA experts and if they take your case, there is a fee-

they can usually assess your chances right away.

Back in 1999,i took a ssd case all the way to the top. I was on p/t from the va. I also had a bad lawyer. The judge called me a liar, i had all the paper work from the M.D.'S. The vocational expert told the judge in his opinion I could not go back to work, This did not matter, I still was denied.

The worst part of this is the hearing was placed on the internet and if my name is googled, the complete case comes up. This has been on the internet a very long time. I am not almost 69 and would like to have it removed but do not know how. If anyone know's how to get google to take this off, please let me know?

Once your name is out there on the WWW. there is no chance to remove it for it becomes public record.

They cannot post your SSN.

Dont feel bad about it. A lot of our names are out there.

Tom - what is your unemployability for?? Do you have written correspondence from your lawyer that he dropped you as a client?? If your disability is for PTSD or other mental disorder you can get the appeal deadline waived because you were unable to understand the appeal process and you weren't represented at the time. This only refers to non-represented claimants.

You can ask them to reopen your Social Security claim and be sure that they use the date you last worked to establish eligibility. I personally have a friend who reopened after 7 years, it was allowed and his back pay went back the full 7 years. SS originally turned him down cause they said he could work again in less than a year.

Remember the quarters don't start when you apply but when you last worked.
