Question

On 11 Apr 08, I sent in my claim for reconsideration of my back to reflect the 3 unresolved comminuted fractures, the pain syndrome and various and asundry medical proclems secondary to the injury.

On 16 Jun 08, I called the 800 # to check if my claim had been received, because I had not gotten a notice of receipt and the yada..yada..you have 60 days.

Today 17 July 08, I get a form letter, that they are processing and the usual lies...you know the one

What is up, don't they ask for additional info anymore to at least make you think they are doing their job or what ?

In case you haven't guessed I'm steamed. I've been misdiagnosed for 28 years, because no one at the VA or in the Army can even read an x-ray. Because of their malpractice I'm now a cripple..true not nin a wheelchair (yet), but have a hrd time getting around and my quality of life has suffered (and me and my family) to say the least.

Yes it will come when they get to it. Normally the Predetermination team will send you the VCAA notice before it goes to the rating team.

I don't quite get the VCAA rules.

I didn't get a VCAA notice before I received my first rating decision from the VA. Does that mean those claims are technically still open?
