Question

IF I AM DENIED AT APPEALS MANAGEMENT THE LETTER SAID MY CASE WOULD BBE SENT BACK TO BVA FOR APPELLATE REVIEW ,AFTER FILING A NOD. AT THAT POINT I AM PLANNING ON GETTING SOME LEGAL HELP. WHAT DOES APPELLATE REVIEW ENTAIL ,AND WOULD I STILL BE ABLE TO WIN MY CLAIM?

Were you able to send to the VA exactly what your VCAA letter said they needed?

A VA claim aint over until it is over-

is there any medical evidence that you could still obtain-such as an Independent Medical Opinion?

Is this instead a question over a PTSD nexus?

Have you done all you can to obtain a buddy statement or Morning , or After Action reports?

If the

BVA again denies your claim you can appeal to the US CAVC (COurt of Veteran's Appeals)

what is the claim for and why are they denying it?

If the BVA does deny you only have 60 days to appeal and you will be contacted by lawyers.

what is policy on communicating private? would you bertha be willing to communicate private if it is not against rules.

I was at the Appeals Management Center and received a denial over the telephone which is against policy.

I was advised to waiver my 60 days to reply to their denial.

I trusted the lady on the telephone and waivered my rights of those 60 days.

Within 2 days I received their denial and I did not agree with anything that was typed.

I immmediatly contacted the BVA of what had happened.

I went and secured an Independent Medical Opinion.

The BVA Judge waited for this IME as it was all within those 60 days.

He granted me service connection.

Yes, you will receive a form to complete and mail back in immediately that you wish 60 days to respond.

If you should receive a denial from the AMC immediately send back the 60 day waiver form, as it takes time for this form to go through the mail and the mail room to the AMC.

The AMC will then again review your claim, if they continue to deny, then your claim goes back to the BVA for review.

After you and should you receive a denial from the BVA then you may have legal representation.

This is how my claim went.
