Finally got it- TVA-The Veterans Advocate- law and advocacy journal by NVLSP-some here subscribe to this publication- it is late because they have altered the format and it is now available on line too-

still $80.00 one year and $120.00 for 2 years- they discuss in the new version 10 top CAVC cases and why they are important-

I cant wait to read it- but it has to wait-too busy here-gee that is like putting a charcoal hot delmonico steak -----

into the ice box-

One thing I just noticed however - 'how to make a claim denial proof'- and they say the evidence should be of such a nature and value that any "experienced and reasonable" rater should have no rational way to deny it.

(of course that depends on the literacy level of the GS VA VA employee)

Negative evidence can often be overcome by additional strong positive evidence.

I take it this is different from the newest editionof the

VBM I just got.

Is it also from Lexis-Nexis.

Did you get just an on-line version or did you get it in

hardcopy or both ?

$80.00 - let me know if you feel it's worth it and/or

how and where I can buy it.

Carla, you can get it from www.nvlsp.org. I've been getting it for about 8-10 yrs. It updates changes in VA laws and cases and basically gives advice as to how to handle claims using the changes, quarterly. These changes are then incorporated into the newest edition of the VBM, annually. It's well worth the money!!

I sure agree with Philip-well worth the money-

I have purchased the VBMs and TVA since 1991.I know the info was instrumental in the awards I received from the VA in the late 1990s.

NVLSP has a new pro bono program for OIF and OEF vets and is still fighting for Blue Water veterans-as pro bono lawyers they have consistently stood up for the rights of veterans.The VBM is on my PC desk and I refer to it during many of my posts here.

This new format is excellent-I think the recent TVA has more then the past ones did.What I didnt see- many it is in there-is how to contact them with specific questions on VA case laws etc.

They have always responded to me by phone over the past 2 decades with any questions I had-sometimes it would take a week or two for the response but still-they do respond.

I am trying to get one of their lawyers to do a show with me at SVR-

the news from VA would infer that OEF-OIF vets are getting fast and accurate claims processing-

the reality is they aren't-

In Sec Peake's attempt to define them as the "new" vets- unfortunately they are being treated like the "old" vets and this devisive statement from Peake only tends to divide us and get off the point that MANY vets are not getting adequate and timely decisions-regardless of when they served.

PS all- Ron Abrams told me I can refer to the VBM here but I cannot publish here entire pages of it due to the copyright law-

I refer to the VBM in my rebuttals for VA and cite the edition and page number etc- thats OK to do-

Terry Higgins- many here remember this vet who did remarkable things to get his award- sent the VA an entire page from the VBM to get one of his awards-

We had a vet here who the VA definitely attempted to tell him he was not eligible for more retro- this was an Agent Orange claim-

I sent this vet the entire page from NVLSP explaining the retro situation of Nehmer and sent him the exact page from Nehmer to send to the VA-he got his retro.

I dont think Ron Abrams NVLSP would mind that I did that.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
