Denied IU; Nod time;

Ditty bag packing list:

One ssdi determination letter with sc med conditions primary&secondary.

One VA 60% single issue rating .

Do I need to add another IMO and new 21-8940?

Thanks Ricky for helping me 'order' my steps. I submit for reconsideration asap with ssdi and other med info on hand. Then get IMO and submit that too. But will hold for NOD about 60days.

It matters a bit in how you proceed. My recommendation is that you take the SSDI award (and any medical records associated with it) and ask for a reconsideration since it was not a part of your claim (I assume they did not have it based upon your post). I would then get the IMO and submit the NOD approximately two months later if you do not hear anything on the reconsideration.

Ricky is right cowgirl, ask for a reconsideration,it faster than a NOD,and it will be looked by the same rater,but remember if your claim haven't been granted in the one year period,you will have to file a NOD to keep your original date you filed claim.Try to get your IMO to state that you can no longer do sedentary (sitting) type or work and why you can't. GOOD LUCK!

Hi All,

I am rated at 90% service connected w/ Agent Orange diabetes and complications. Last June, 2007 I filed for re-evaluation from 60% and TDIU . After 11 months I was awarded the 90% but denied TDIU. I sent in an appeal and was denied by the RO after another wait of 10 months. I have made an appeal to the BVA( I call them And was told that they are working on 2006 claims) But while waiting, my DAV rep suggested I go through the Vocational Rehab and get a lob evaluation at a light duty sedentary job( at an Ins office). I completed it and was found unemployable. I received the denial 2 weeks before the voc rehab eval was completed. The RO has been informed of the voc rehab, but i'm not sure what they will or might do.

Any thought?

Your BVA denial should have included the steps for asking for a reconsideration at the BVA level. I would obtain an IMO and take the IMO if favorable to your cause and the Voc Rehad paperwork and ask the BVA to reconsider their decision.

Have you applied or do you get Social Security Disability? If you get SSD please be sure and make VARO aware of it. I think that if you are not working and with evidence that supports the TDIU you should get it.

[Thanks for thr reply. I haven't been denied from the BVA yet, the deniel was just from my RO in Denver. I did send in my appeal for the BVA to review things. soory for the confusion.
