Question

i first applied in 1987 for bi-polar was in bad shape could not follow claim,

did not know policy about filing appeal,claim was denied,and i forgot about it.

filed again 2001 bi-polar won 30% but retro went bback just to 2001 can i

make claim i was unable to follow through in 1987 due to mental illness,

which is true.

Oh that is different!

I say dump this POA and get another one- try to find out if the POA has the older decision in their file on you first-

I emailed the vet I mentioned to see if he has ever gotten a decision on his CUE-will let you know when he replies-

Same thing sort of happened to me but it was in 1971. I was rated 10% for residuals of schizophrenia while the VA ignorned a medical report from my doctor saying I was totally incapacitated, and unemployable. 30 years later I get the 70% rating plus IU for the same disorder. I filed a CUE using a lawyer to be sure I got the pleading right. I was denied at the VARO and did not appeal because I did not even know that I could since I never got a regular rating decision with rights. You were denied and I was low balled. What evidence did you have that your bi-polar was service connected and what evidence did you have that you were totally disabled? We realize now that often the VA just stamps a claim denied hoping that the sick vet will just go away. This happens often and you and I are proof.

YEAH, THEY WISH I WOULD GO AWAY ,AND I WOULD HAVE IF I HAD BEEN

TREATED FAIRLY . NOW HOWEVER I AM GOING TO BE ON THEM LIKE A BULLDOG.

I WILL NEVER GO AWAY UNTIL I AM SATISFIED I HAVE BEEN TREATED FAIRLY.

I HAVE BEEN CLEARLY SHAFTED AND DO NOT INTEND TO LET IT GO. I LEARNED ONE

THING I DOESNT DO ANY GOOD TO GET ANGRY AND OUT OF WHACK LIKE I HAVE DONE

IN THE PAST ,YOU JUST HAVE TO STAY ON THEM CONSTANTLY. GET THE BEST ADVICE

YOU CAN AND MOVE ON IT .

Skunk-the friend I mentioned told me he has not heard a word in over 3 years on the CUE I prepared for him-

I dont think he filed the claim.

It took me 3-4 years to get him to file a SF 180 I had prepared for his discipline and personnel records-it was in his desk but he would forget to file it- finally he did and that is how he won his 12 year old claim-went from no SC to 100% P & T. With his Disciplinary and personnel records-

He would have heard something by now if he had filed the CUE.

Sorry-I thought maybe we would have a good example there to use.
