We just got a CUE award and we didn't even file for it. We've filed a CUE on something else recently, but this isn't for that. This is a CUE award for the NOD that was filed in June. I'm over the moon about this CUE, and very hopeful that they will award the CUE that we've recently filed for. YAY! Like I said, I'm so over the moon I can't even put it into words!

That is where it gets screwed up. He was discharged, then wasn't seen for a routine exam until August 1996. There was no improvement.

So they are saying they established a retro 50% award from Dec 1993 up to August 1996 and they then dropped it to 30% ???

So they owe 39 months at 50% less whatever % he got then- and then they reduced to 30 ????

What happened on Aug 27th 1996 or up that point from Dec 1993 that showed he had substantial improvement from the 50% ?

File a NOD stating this is another cue in the making as the VA has no basis in reducing your husbands percentage.

They way you good folks are being treated is a living shame. Also show the award to your congressman and ask him to personally get involved.

The law they are referencing says that you have to be re-examined within six months, and because he wasn't seen again until 1996, they figured they'd pay up to then and hope we wouldn't notice. What should I do about that part?

I see the CUE award and question the reduction as Berta does.

They are playing give and take with you.

File a NOD stating this is another cue in the making as the VA has no basis in reducing your husbands percentage.

How is it that they have reduced this Veteran without a C+P exam or anytype of followup ? In order to justify this reduction ? does not make any sense. gosh. terrible
