Dro Hearing Cancelled! Mother *********!

Question

I drove 70 miles to Buffalo today to be told "um.... your hearng was cancelled a week ago. NYS Veterans Affairs was told, didn't they tell you?"!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

I swear..... I'm gonna lose my ****

After my meeting in Buffalo 3 weeks ago I was told that my NYSDVA rep would get an a**chewing for doing a lousy job. he called 4 days ago and said "Hi, this is **** ****, call me about your claim." I got a card in the mail yesterday that said the same. My dumb a** figured it was cause he got chewed out so I went to Buffalo today and oh...... the DRO had something to do so the hearing was cancelled. I asked why VA itself didn't send me a letter and was told "um..... I don't know. I don't know if we do that so long as we call your POA and tell them".

So I pulled the card I got from my rep out to show them and they said "he didin't specifically say in the message or card that you needed to call cause the hearing was cancelled? Oh boy....."

I am livid right now.........

The guy at the dsk called the schedule guy in the office and asked him if he could give a new date and that guy said 'sometime within the next 6 months". He then asked if I could get placed on top of the pile and the guy said "I have 12 or 15 files here.... they get rescheduled as they came to me, sorry".

I waited 5 months for the first hearing to be scheduled and it was the one week of the year I couldn't do it (a wedding across country) and then waited 3 more months for this.......

UNACCEPTABLE............. seriously.

If you want to contact their Director or the VA OGC about this -I can give you contact numbers-(re NYSDVA)

I am SO GLAD I took a stand against them.

I am far from Buffalo too and when they stood in for me at a DRO conference that is when my IMOs disappeared.

The Staff attorney at OGC in DC is Dana Rafaelli-

Maybe if you contact their Director (NYSDVA) and say this is your next call (Ms RAfielli at the OGC) if he doesnt do something about this--you might get results-

feel free to tell him you got Ms. Rafaelli's number from Berta Simmons in COhocton, NY.

I would have to email you the OGC number if you need it- but Colonel MCDonough-director of the NYSDVA can be called or emailed at

http://www.veterans.state.ny.us/staff.html

and if you email him send a CC to the Governor's office too

Those B^%$#@ turds!* have hurt too many veterans-

If NYSDVA was notified of the change then I would force them to handle the issue. Although they may be a bunch of worthless SOBs they still have more influence with the RO than you do.

I drove all the way to Little Rock for my BVA Video-Conference hearing (200 miles). They told me that they lost Video feed connection and I would have to reschedule. I told them there is always audio and/or Phone conference. They went to check on it. They came back and said, "Oh! oh!!, we just got the Video feed connection back". I finished the BVA Video Conference.

I am just numb...... I have been waiting for this hearing for monthsand months and now after nights of tossing, turning, having my stomach in knots, etc. to have them just say "oops" is just unbelievable.

I mean, if I don't show up at that meeting, I get denied. They don't show up and it is just toush S*** for me.

the regional head of NYSDVA is SUPPOSED to call me tuesday about this. We will see.... or with my luck I will be at work and not be able to take the call.

I'm sure it won't make you feel any better, but they do this to my husband all the time. They cancel appointments, C & P exams twice, etc. It is the VA. They do it all the time.

With the VA anything is possible both good and bad. Persistence is what pays off in the end. You have to wait them out and hope you live to see it.
