Va Disability Comp And Unemployment Com

Question

I am currently receiving VA Disability payments at 40%. Last week, I was laidoff by my employer and they told me that I can collect unemployment. Can I receive both VA payment and unemployment at the same time? Or will the amount be offset? I tried researching online but only seen wording on " Vo Rehab and VA eduacation Benefits " must be reported, nothing about disability payments. Can anyone please shed some light into this? Thank you.

In California the only way that I have heard of is if a doctor says you cannot work in your usuall occupation. I have rec'd both on numerous occassions. They do not even ask if you receive VA comp.

The reason why it was they said "economic" is simply what they said. They reason why I wrote it that way is that if a I get a good Laywer and pursue with it, it was down right shady to me. I laid off on Veterans' day??? And a Tuesday??Any power house attorney can spin this around into a discrimation suit.

But I am not going to do that because they were too dumb to know what they did. Only one other person got laidoff and I don't know the rest of the details. Now months from now, I will collect the details of who else got laid off. But a disabled Veteran getting laid off on Veterans Day is down right shady and tackless. I am only doing the best of things that I can control.The point is, I ain't going back where I use to work. And I am not bringing any ADA stuff out. I am more pissed that they laid me off on Veterans Day. And it was not even my performance, it was just heads that they wanted.

This only adds to the fact that the VA denied me because " I was working" and appears to be doing "OK", but my NOD stated that I have a tough time keeping a job, but they still denied me. These written evidence will now only help me win my case, using the same words against the VA.

I should have enough quarters, I have been working a progressive and decent wage since high school.

Veterans Day is just another day to many people, evidently including your former employer. Unfortunately, it's very hard to prove a discrimination claim, especially when several people who are not disabled are also laid off. It's not illegal for an employer to be a heartless jerk, and you'd have to prove your termination was due strictly to your disability. That's a high standard, and lawyers will only take slam-dunk lawsuits on contingency. Otherwise, you're paying through the nose by the hour. My point was to see if you could use any of the circumstances behind your termination to your advantage in a TDIU or SS disability application.

Again, my suggestion is that you file for unemployment, file for TDIU, and file for Social Security disability now -- and continue to look for employment. If you find another job, drop the TDIU and SS disability applications immediately. At least this way, you've got some sort of income coming in with your VA disability compensation, and you have a chance at adding to that with TDIU and SS disability once your unemployment runs out. If you find a job in the meantime, great. Either way, I hope things end up the way you want them to, to your advantage.

Thats exactly my situation is and what my plans are. Thank you for your support and suggestions.

Now that I have all the time to devote to my claims, it can be a life changing event if I plan, excecute, and play my cards right.

Appreciate the help.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
