Ptsd Increase

USMC_HVEQ

Question

I thank everyone that reads my posts and offers some advice. I thank god this service is here, because it helps you answer questions, that jsut nag at you.

My situation is this:

currently on TDRL (10% ptsd and 40% subluxation for both shoulders)-combined 40% for USMC as of 8/1/07.

current VA ratings 10% tinnitus, 10% ptsd and 40% shoulders (they decided my VA case before I got all the evidence, based on my TDRL letter and now I am combined 50% VA comp.

I was receiving both pay up until next month when my TDRL pay is being offset by the VA waiver (50%) amount of 770. I will rec the difference which is about 187 dollars.

I have a NOD in process, I had my C&P exam for ptsd and most likely will be rated either 50% or 70% ptsd. I asked for DRO review by de novo process.

My questions are the following:

1. When my VA rating is increased for ptsd, what should I do about CRSC? I was only given 10% at the time of my retirement/tdrl (which was bogus, but I took it at the time), so at the time I did not qualify for CRSC. My shoulders were hurt in service but not in combat. My ptsd is combat related from Iraq, which should qualify me correct for CRSC?

2. when my first reval for tdrl comes up, I should have no probelm getting transferred from tdrl to pdrl with rate increase, I imagine, based on the new evidence and rate increase by the VA.

3. If you are getting 70% combined VA rating and not CSRSC, then your retiree pay (CDRP) is offset, since its only 50% on TDRL, but if I have pDRL ratings changed, since my ptsd is far more serious then my shoulders right now, then I would qualify for CRSC pay in addition to the 70% VA money correct? I bleieve it is 2.5% of retiree pay x #yrs of service?

well now that we have that issue settled as far as noting that my ptsd is coded 9411, what is the next steps I need to do?

how is pay computed?

will this be in addition to my VA comp pay or will it still be reduced?

I'm in the final stages of having a rate increase from 50% VA combined to 70% VA combined, where ptsd was the reason it was increased and that was increased to 50%. I sitll havent had a TDRL follow up visit yet, does that matter at this point?

Yes CRSC including your VA check USMC_HVEQ: you are a Marine. My brother was in the Marines Da Nang 66-69. I have a lot of respect for you guys. Each branch of the Military handles it's own CRSC. You are 50% VASRD # 9411. Your monthly pay depends on your rank and years of active duty. From what you have presented here, I belive that you were in the military for about 7 years and probably a NCO. I regret to report that you will probably not get much money per month. It will come in with your VA comp. check or direct deposit. It is non-taxable. It is concurrent. You have to apply thru the Navy. It's not much $$$, however I'll take it as a win with these guys. Call the Navy at 1-877-366-2772 or this website online at http://74.125.47.132/search?q=cache:ol1COP...lient=firefox-a CB92-93

My VSO was a waste, I just dont feel like shopping around for others. I'll jsut ask questions...someday I can help others having gone through the process.

Yea so 50% CRSC or another calculation, which ever is greater.

Thanks for raising the topic USMC_HVEQ. You have helped other vets by your topic post, when they come here looking for CRSC info. Defense Authorization Act (NDAA) was signed into law on Jan.29,2008 to include a new component for Combat Related Special Compensation (CRSC) including permanent and Temporary Disabled Retirement List (TDRL ) retirees with under 20 years of active duty. Retro to Jan.1,2008. From start to finish, it took me under 60 days to get the check...

It's been my experience, ... the VSOs, generally don't want to get involved into the filing of CRSC applications. Reps from two of the established VSOs, told me they got memos to stay out of CRSC issues. Please, someone tell me it isn't so. Any CRSC success stories out there?...
