Ad Rape - Engaged In Combat With The Enemy

Question

I've been asking myself for a few years now,

why is it that VA does not consider victims of

active duty rape, the same as a combat veteran -

when you take into consideration the definition of

"engaged in combat with the enemy" ?

When you are raped on AD, I no longer consider it as

raped by a fellow service member, I see it as rape is an

encounter with a military foe, a hostile unit, an enemy force.

VA's General Counsel has held that the ordinary meaning of

the phrase "engaged in combat with the enemy," as used in 38

U.S.C.A. § 1154(b), requires that a veteran "have

participated in events constituting an actual fight or

encounter with a military foe or hostile unit or

instrumentality."

What do other's feel on this issue ?

i don't think rape and combat are the same, both very traumatic, but different. rape by a fellow soldier is so horrifying the realization that the your buddies who are suppose to cover you and have your back leaves you feeling that you have no where to go and safety will never come.

i don't want them to confuse combat with mst. combat is a special kind of hell, but we sign up and know if called we will go and we will do our duty and we go through it with our buddies. but rape, no one signs up for that and each and every rapist needs to be held accountable and punished to the full extent of the ucmj.

A service member that commits rape against a fellow service member,

is a subversive service member, they are intentionally harming USA

Goobermint property.

We signed up knowing we could be in a combat area.

What we did not know is that we had the enemy right in our base camp.

What we did not know is that our commanders would cover for the enemy.

Correct, several charges should be applied. 1. Rape, or aggravated sexual battery, 2. Damage to Government Property. 3. Conduct Unbecoming. 4. Treason. It really is also Treason if you get down to the heart of the matter. It should be punishable by life in prison or death.

Well, Mike, we thought we were watching her, being very careful.

But, there is no way to combat something you can't see coming......like the next door 16 year old walking into the back yard where my daughter was playing and pulling her into their garage. This is a kid that mowed our grass, whose sister used to baby-sit for us, whose Father was a member of the same lodge as myself.

And, I was away from home that afternoon, working. Her mother was there and her mother blamed herself for NOT watching our daughter, but, of course, it wasn't her fault, either. I'd have done the same thing......thinking that an eight foot chain-link fence was adequate, never thinking that someone would be bold enough to walk into OUR garage and into our backyard. Of course, our daughter didn't think anything was amiss so she never got a chance to resist or whatever a 5 year-old could do.

Larry, My heart goes out to you and your family. This story makes my heart ache. I could only imagine how I would have dealt with the little creton.
