Nexus Letter Template For Private Dr Or Therapist!

Question

Read it closely very close and you will see that is more clear than the original va document for a nexus letter. I did some changes on it so that it would be clear as you can see i took out possible and put not and also added a couple of words here and there. Also the old letter was used for VA doctors so i made it for private doctors. Now you can write or use any form to submit to the VA...

In my medical opinion, the currently existing medical condition is

How much proof do I need on a claim?

VA law requires the "as likely as not" standard. Doctors are used to stating opinions to a medical certainty. That is a much higher burden of proof. Show your doctor the following chart. It may help.

continunum of causation -- burdens of proof

standard ---------- how much --------- context

as likely as not --------- at least 50% ------- verteran claims

more likely as not---------- more than 50% -----civil trials

clear and convincing------ about 75% ----civil juvenile court

to a medical certainty===about 80%------ court doctor opinion

beyond a reasonable doubt----- about 90%----criminal trials

beyond a shadow of a doubt-----100%------ignorant doctors

How to give an opinion for Nexus (relationship to a military incident)?

When asked to give an opinion as to whether a condition is related to a specific incident during military service, the opinion should be expressed as follows:

1. “is due to” (100% sure)

2. “more likely than not” (greater than 50%)

3. “at least as likely as not” (equal to or greater than 50%)

4. “not at least as likely as not” (less than 50%)

5. “is not due to” (0%)"

C&Pman,

Why would you come and alter this form as such ?

You have just made it less advantageous to the veteran.

By removing the word possible - you just destroyed part of

the BOD used in medical evidence.

Do us a favor and don't copy a form - change it to your liking

and then post it. New vets that come on here will think

that's truly how the form was created !

oh wow i see what you saying now...as was thinking that the VA would look and want to see how the doctor could say no it not realated instead of having all three for the veteran....

Is a friends testimony the same as a nexus letter? Do they have to put their information on a particular form.

For instance, If I can get in touch with my Medic, He gave me a butt load of Motrin overseas, but I don't think this is in any of my records.. If I got him to write a statement saying that he remembers giving me some medicine for my hurt back overseas. ?
