    Tips on posting on the forums.

    1. Post a clear title like ‘Need help preparing PTSD claim’ or “VA med center won’t schedule my surgery instead of ‘I have a question.
       
    2. Knowledgeable people who don’t have time to read all posts may skip yours if your need isn’t clear in the title.
      I don’t read all posts every login and will gravitate towards those I have more info on.
       
    3. Use paragraphs instead of one massive, rambling introduction or story.
       
      Again – You want to make it easy for others to help. If your question is buried in a monster paragraph, there are fewer who will investigate to dig it out.

    • Question A. I was previously denied for apnea – Should I refile a claim?
      • Adding Background information in your post will help members understand what information you are looking for so they can assist you in finding it.
    Rephrase the question: I was diagnosed with apnea in service and received a CPAP machine, but the claim was denied in 2008. Should I refile?
     
    • Question B. I may have PTSD- how can I be sure?
      • See how the details below give us a better understanding of what you’re claiming.
    Rephrase the question: I was involved in a traumatic incident on base in 1974 and have had nightmares ever since, but I did not go to mental health while enlisted. How can I get help?
     
    This gives members a starting point to ask clarifying questions like “Can you post the Reasons for Denial of your claim?”

Read it closely very close and you will see that is more clear than the original va document for a nexus letter. I did some changes on it so that it would be clear as you can see i took out possible and put not and also added a couple of words here and there. Also the old letter was used for VA doctors so i made it for private doctors. Now you can write or use any form to submit to the VA...

How much proof do I need on a claim?

VA law requires the "as likely as not" standard. Doctors are used to stating opinions to a medical certainty. That is a much higher burden of proof. Show your doctor the following chart. It may help.

continunum of causation -- burdens of proof

standard ---------- how much --------- context

as likely as not --------- at least 50% ------- verteran claims

more likely as not---------- more than 50% -----civil trials

clear and convincing------ about 75% ----civil juvenile court

to a medical certainty===about 80%------ court doctor opinion

beyond a reasonable doubt----- about 90%----criminal trials

beyond a shadow of a doubt-----100%------ignorant doctors

How to give an opinion for Nexus (relationship to a military incident)?

When asked to give an opinion as to whether a condition is related to a specific incident during military service, the opinion should be expressed as follows:

Why would you come and alter this form as such ?

You have just made it less advantageous to the veteran.

By removing the word possible - you just destroyed part of

the BOD used in medical evidence.

Do us a favor and don't copy a form - change it to your liking

and then post it. New vets that come on here will think

that's truly how the form was created !

oh wow i see what you saying now...as was thinking that the VA would look and want to see how the doctor could say no it not realated instead of having all three for the veteran....

Is a friends testimony the same as a nexus letter? Do they have to put their information on a particular form.

For instance, If I can get in touch with my Medic, He gave me a butt load of Motrin overseas, but I don't think this is in any of my records.. If I got him to write a statement saying that he remembers giving me some medicine for my hurt back overseas. ?

No, it is not the same. Your friends let would be considered a Buddy Letter and it would be good if he could mention the incident/s, date and organization that you both were in at that time. VA sometimes likes to check up on these things and it would add validity to your claim. The VA has the option to consider it or dismiss it. Often if the buddy does not state something to the effect like this,

'this statements on this form are to true and correct to the best of my knowledge and belief.'

then it 'more likely than not' would be considered. Keep in mind if the VA was to determine the buddy was lying, the could prosecute!

If your buddy was a medic who treated you and later got out of service, went into on to become a doctor and was being treating you... then he could provide you with a reasonable NEXUS if he can back it up with his scientific/professional knowledge.

Do a google search on VA veterans NEXUS and there will be a ton of information on the 3 critical parts of a NEXUS letter.

The nexus letter needs to have a 'rational' for the opinion. One of the VA doc wrote a simple one similar to the above, stating, is likely as not, and said my husband could not obtain or retain employment due to being P&T disable due to his service connection PTSD. The RO dismissed the letter due it not having a 'rational of DR.
*name* opinion". We did get three more nexus letters with 'rational' but we (I)
did a rebuttal of their denial issues line by line. SOC we addressed each of
the RO reason for denial. On the dismissal of the VA Doc nexus letter not be use
because no rational, we stated
the doctor's option with out
explanation or rational should be accepted as her expertise and opinions was
accepted for the care of the veterans. Our thought was if she is not qualified
to give a nexus letter why was she treating Veterans. Anyway, to prevent this
from happening on a nexus letter, I suggest the letter also contain a rational
of the opinion to prevent the RO from dismissing the nexus letter.

Agree with Aletta. I am currently going through an appeal because my VA doc said my headaches were related to my cervical spine condition, but did not initially provide a rationale. The C&P PA (not a Dr) opined that it was not related and provided BS rationale. The VA still made me go all the way to appeal even after my VA doc provided rationale. They were not satifisfied with his broken english. He is hispanic and he didn't use proper english. Decision will be soon, hopefully!

This topic's last reply prior to being reopened was June 2009, four years ago.

With VA benefits - lots of changes can happen over a four year period.

The topic relates to

The original topic contains poor information - someone took a form and changed it to

their liking - which was not in the best interest of veterans obtaining va benefits.

ie: buddy letters.
