1151 Claim Can Put A Hold On The Other Claims

Question

Baltimore,MD VARO told me after I file a 1151 for a claim that it put a hold on other claims the VA is working on for me. I may not hear anything until next year. Is anyone aware of this problem with the VARO in your State?

Section 1151 claims should be processed in the same way and time frame as all other claims are-

but since claims have hit close to one million this year-it sure might not be until next year when you hear something on this claim.

My Section 1151 claim took over 3 years to award.I kept knocking down their 'expert' medical opinions.Even after they got copy of the FTCA award, they still managed to deny it.But they reversed upon a call from the OGC.

Section 1151 claims need bonafide proof of malpractice and documented disability or death directly due to the malpractice based on medical rationale.

Very few 1151 claims and FTCA claims succeed these days without an independent medical opinion.
