File 1151 for Prostate Cancer Surgery and side effects from Surgery. How long will it take to hear from the Baltimore,MD VARO? Thanks you Hadit.com Veterans Friends....I'm helping a Veterans with claims

Yes- very hard to say-

I do not believe the VA is required to send a VCAA letter at all- on 1151 claims- they dont have to make it easy for a vet to prove negligence.

This vet needs documented proof of the malpractice.

Of course the VA med recs wont say 'oops we buggered this one'.

Malpractice has a pattern and/or a trail- it is always found within the VA records if it occurred.

Also if VA messes up but corrects the problem, there is no negligence.

And the negligence must have caused proven additional disability to the veteran.

Has the vet considered getting an IMO?

Have you carefully read all of his med recs?

Do you have a good medical symbology chart and medical dictionary?

My malpractice claims stemmed in great part due to one word on a VA ER certificate.

A word my daughter ( USAF linquist and analyst) helped me to decifer.

It was hard to read.

Then I looked up the other medical symbols on this record.

And then I studied the subsequent VA med recs-

Absolute malpractice.

And then I discoverd the cover up.

There is a lot to malpractice and 1151 claims.

Surgeries can have known side affects and events that might or might not fall into what negligence really is.
