Texas House Bill No 3613

Question - I just bought a home last week and it is in my name now (I am moving from out of state (returning home after a long military career away from Texas if that has any bearing on my question). Today I went to the Montgomery County Tax office to file for my 100% Veterans disabled tax exemption to get the $2,210.00 in taxes back from the escort account the mortgage company took out. The lady who helped me said that I would not get any of that back because I bought the home AFTER January 2012 but would be exempt for the year 2013 so I am out $2210.00.

I DO NOT think this is correct according to the law as described in section 11.131, it clearly states in section (b), " A disabled veteran who receives from the United States Department of Veterans Affairs or its successor 100 percent disability compensation due to a service-connected disability and a rating of 100 percent disabled or of individual unemployability is entitled to an exemption from taxation of the total appraised value of the veteran's residence homestead".

So my question is - Do I owe the $2210.00 of this year or should I be receiving an exempt letter from Montgomery County to present to the mortgage company to receive the $2,210.00 back?

I just left the appraisal district office for Comal County.

  • I gave them the form (Property Tax Form 50-114)
  • A copy of my award letter stating I was retro to Nov 2010
  • A copy of my drivers license and a copy of my vehicle registration.

The very nice woman who helped me told me that I will receive a rebate of the entire amount for 2011 and will not have to pay 2012. They are also writing and sending me a letter to forward to my mortgage company that states that due to my SC disability of 100%, I am no longer required to pay property taxes on this property.

I LOVE TEXAS!!!

Inthewind,

When Rockman received his letter that he was 100% P&T, we had already paid the 2011 property tax. We applied for the exemption. About three weeks ago we get a check from the State of Tennessee for the amount of the propeprty tax we paid. We were told that we have to go in once a year to renew this exemption, but I do not remember exactly what I will have to do then.

In Texas, its a one time filing. Not that it would matter, my county appraisal office is never busy and the people are nice. Unless...it was like last year when they raised our taxes the most out of everyone in my neighborhood! Then it wasn't too pleasant because we were disputing it.

Tennessee needs to be like that. If you have a lifetime waiver, I could not see why I will have to apply each year. It seems like once you and 100%, then that is not going to change. I just have to make sure I do not forget. It could, maybe, for in case you move to another county,the county is aware of it and the tax rate is different. I am glad you have that benefit!
