    Tips on posting on the forums.

    1. Post a clear title like ‘Need help preparing PTSD claim’ or “VA med center won’t schedule my surgery instead of ‘I have a question.
       
    2. Knowledgeable people who don’t have time to read all posts may skip yours if your need isn’t clear in the title.
      I don’t read all posts every login and will gravitate towards those I have more info on.
       
    3. Use paragraphs instead of one massive, rambling introduction or story.
       
      Again – You want to make it easy for others to help. If your question is buried in a monster paragraph, there are fewer who will investigate to dig it out.
     
    Leading too:

    Examples:
     
    • Question A. I was previously denied for apnea – Should I refile a claim?
      • Adding Background information in your post will help members understand what information you are looking for so they can assist you in finding it.
    Rephrase the question: I was diagnosed with apnea in service and received a CPAP machine, but the claim was denied in 2008. Should I refile?
     
    • Question B. I may have PTSD- how can I be sure?
      • See how the details below give us a better understanding of what you’re claiming.
    Rephrase the question: I was involved in a traumatic incident on base in 1974 and have had nightmares ever since, but I did not go to mental health while enlisted. How can I get help?
     
    This gives members a starting point to ask clarifying questions like “Can you post the Reasons for Denial of your claim?”

Help With Nod And Increase.

Question

I am about to file a NOD on a couple of issues that were denied. I feel i have some better evidence and a IME from a private doctor that can swing these items in my favor. I also have a 30% ptsd decision i feel was underrated; but have been going to vet center and that wasnt taken into account in my claim. Does someone have any advise on how to go about doing this? i like to make it short and sweet.

I am about to file a NOD on a couple of issues that were denied. I feel i have some better evidence and a IME from a private doctor that can swing these items in my favor. I also have a 30% ptsd decision i feel was underrated; but have been going to vet center and that wasnt taken into account in my claim. Does someone have any advise on how to go about doing this? i like to make it short and sweet.

The shortest and sweetest way to handle this is to file a simple NOD and request a hearing with the local DRO. That way you can present your evidence and arguments in person.

I read about two types of DRO review, one being personal meeting. If i can not make the meeting will a VSO handle this for me? Also for the PTSD 30% rating; i do not have records from the Vet Center counseling; and neither did the original rater. can i just tell them in nod to get my records?

Chris,

1)

You can get a copy of your records from the Vet Center and submit them

to the VARO yourself.

A psychologist I had in the past (that was the team leader at

my Vet Center) stated this is better for the Veteran as this way your

provider at the Vet Center can provide the information they have that relates

to your SC'd conditions and anything that relates to your current claim.

Somethings are better off staying between you and your Vet Center provider

and not being released to the VARO.

2)

Your other option is to sign a blanket release of Information to the VARO from

the Vet Center - then the VARO will most likely get everything.

Now when they read the entire Vet Center notes, there could be something in there

that would be a negative towards granting your claim.

I do not advise to do any lying to VA or the Vet Center - some things

just have nothing to with your claim - but the VARO can take that information

and use it against you.

I opt for the first option.

I did not know that you can pick and choose which information to send to the VA from the Vet Center. Can this also be done at the VA hospital?

If you get your records from the Vet Center then it's upto you

on what you decide to submit to VARO,out of those records.

In fulfilling the duty to assist, VBA is supposed to get your records from the VAMC,

if you have told them this is where you get your medical care,

especially the specific records that you have told them relate to your claim.

I submitted a letter from my vet center saying "PTSD, chronic and severe". The VA ignored that, and diangosed me with a different string of disorders. I got IU, but the Vet Center was a waste.

If a VSO has the power of attorney for your claim then yes they would attend the meeting alone if you for some reason could not make it. HOWEVER, remember, it is your claim and no one is going to care about it like you would.

So I would request the meeting and make sure that I was there (if you have a vso they will be with you).

Clown Man's opinion is exactly my opinion: "remember, it is your claim and no one is going to care about it like you would" which I plan on requesting a DAV VSO Rep join me in my DRO hearing but I am not holdiing my breath on that. IMHO they do many good works and have I am sure many good people. I personally meet zero to none of them. So I and would suggest, exactly what I am going to do, depending on your condition to travel and confront an advesarial group or person, is to request your VSO accompany you to the hearing. That may or may not occur. I will obtain an IMO, even if it is just a ambulance chasing chiropractor ( nothing in particular derogatory-just a money factor and traditional opinion that you can bet won't be lost on the Hearing Officer), gather all MRI image Disc's/MRI evaluations/Consults/whatever you can get, then assemble in a chronological comprehensible way to display to the hearing officer/s with as little /I said she said sort of things as possible. Irrefuteable facts. Practice your presentation.

I hope any part of this is of use.

I have useful experience with PTSD so I will bow out on that issue.

I recently filed a NOD with the VA and it was denied. I am at a loss as to what to do as well. The odd thing is that even though I was denied for my claim for PTSD, I was scheduled for a C&P during the following week. (tomorrow as a matter of fact) Is this customary or is it a ploy by the VA to shortchange me again? I hope that I am not stepping on the original's questions, and if I am, please someone direct me to the proper place to inquire.

The C&P is an indication that they are still trying to decide on your claim. Your NOD was it a letter or on Form 9 and did you already get a decision from your VARO denying your claim?

The onoly other thing I can think of is a DRO saw something that needed to be checked out.

Go to the Vet Center and do what carlie suggested... Back in the old days,to protect the veteran, the Vet Center kept it's own set of written records, so the VA cannot just flop in and invade your therapist - veteran privilege. It could contaminate the relationship between the vet and Vet Center. The VAMC uses an electronic recording system. The Vet Centers uses a paper system. At least that is the way it use to be. The "Help Without Hassles" format was established to reach out to the veteran that had Hadit with the VA or VAMC, and wanted some place more private. I just hope big brother hasn't knocked down that wall of privacy also.

question.

when i first got my award letter the awarded me 30% ptsd and denied a few others. I am going to submitt a NOD letter for the "others" and in order to get a increase for the ptsd do i also call it a NOD? I am using hadit's NOD template.
